Define Alcohol?
Any beverage containing more than 1/2 of 1 % of alcohol for beverage purposes, either alone or when diluted.
Define Beer?
Any malt beverage containing 1/2 of 1 % alcohol by volume and not more than 4% alcohol by weight.
Define Liquor?
Any alcoholic beverage containing more than 4% alcohol unless otherwise indicated.
Define Malt Liquor?
a MALT BEVERAGE containing greater than 4% alcohol.
Define Wine & Vinous Liquor?
The product obtained from the alcoholic FERMENTATION of juice of sound ripe grapes, fruits, berries, or honey. (Includes wine coolers)
Define Distilled Spirits?
Alcohol spirits of wine, whiskey, run, brandy, gin or any liquor produced in whole or in part by the process of DISTILLATION.
Define Mixed Beverages?
One or more servings of a beverage composed in whole or in part of an alcoholic beverage in a sealed or unsealed container or any legal size for consumption.
What is an Illicit Beverage?
Any beverage handled in violation of the Alcoholic Beverage Code. Those that are illegally:
- manufactured
- distrubuted
- bought
- sold
- stored
- etc.
Permit vs. License?
A PERMIT authorized the handling of LIQUOR; while a LICENSE authorizes the handling of BEER.
Permittee or Licensee?
A person who is the holder of the permit/license. (Also any representative of the business (Doorsman, bartender, busboy, manager, police officer/security) is subject to SAME RULES as person whose name the license is under.)
Licensed Premise
Grounds and all buildings, vehicles, etc pertaining to grounds if directly or indirectly under control of same person.
What is prima facia evidence that a beverage is considered liquor?
Proof that the beverage contains greater than 4% alcohol by weight.
Wine/Beer Retailer Dealer’s Off Premise Permit…
May sell beer, wine, malt liquors not over 17%. (Think 7/11 store) May not consume or knowingly sell to another retailer.
Retail Dealer’s Off Premise Permit
May sell beer and wine (Think Supermarkets)
Criminal charge for Consuming at retail store?
Class C Misdemeanor (does not include special tastings)
Wine/Beer Retailer’s Permit
May sell beer, wine, mart liquor not over 17%. May consume only what they sell.
Beer Retailer’s On Premise License
Sale of BEER ONLY! Employees may consume only what they can sell. Customers may BYOB spirits/wines.
Mixed Beverage Permit
May sell any time of alcohol/beer by the drink. May consume anything they sell. 7a-midnight M-Sa. Sun. 10a-midnight (with food) or else noon to midnight.
Hours of Sale?
Tarrant: Mon-Sat 7a-2a. Sunday 12p-2a (10a-2a with food)
Wine Only Package Store?
May sell wine, ale, malt liquor. Must be 16 to work. May NOT consume
Package Store Permit?
May sell liquor, malt liquor and wine. If want to sell beer, need a BF too. Hours M-Sa 10-9p No consuming except under certain conditions. Must be 18 to work here except a child of the license holder can work here.
If Christmas or New Years falls on a Sunday, when must the liquor store be closed?
The Monday after the holiday.
If you see a sign on the door warning of the crime to consume liquor and you’re making an arrest, what should you do?
Take a photo of the sign.
If you notice a BLUE WEAPON sign, what will that do to the penalty?
Enhance it to an 3rd Degree Felony (F-3)
