What is the composition of a Supreme Court?
- Chief Justice appointed by the president
- 25 other judges appointed by the president in consultation with the Chief Justice.
What are basic qualifications for a judge in the Supreme Court?
- Citizen of India
- High court advocate (lawyer) for at least 10 years or high court Judge for at least 5 years
- Distinguished jurist (law expert) in the president’s opinion
How long can a Judge remain in office?
Till the age of 65
How can a judge be removed
- Can only be removed by the president on proven grounds of misbehavior or incapacity.
- Through a process called impeachment
- Passed resolution through both parliament houses with a majority from each house where at least 2/3 of the members are present and voting.
What disputes is the court mainly concerned with under original jurisdiction?
Disputes between:
- union and one or more states
- union and state (s) on one side and one or mare states on the other side.
- 2 or more states
In what cases in appellate jurisdiction applicable in Supreme Court over High courts and other courts?
- Interpretation of the Constitution
- Sent by high courts
- A high court changes the decision of a lower court to a death sentence
- during review of it’s own earlier decisions
When is Advisory jurisdiction exercised by the Supreme Court?
When the president seeks advice on laws and constitutional issues. However, this advice is not binding on the president.
How does the Supreme Court supervise the courts below it?
By checking whether they are following the procedures or not.
