What are the aims of senetncing
- Deterrence - Put people off committing crimes again, can be general or individual
- Revenge - To pay back
- Rehabilitation - Perform and function in society again.
- Protection of public - Prevention of crime
What are the two ranges of sentencing?
- Improsonment - suspended
2. Community service - Anger management, drug/alcohol rehab, voluntary work. (Under LASPO2012)
LASPO2012 comes under which Act?
Legal aid sentencing and punishment of genders Act
How much can you be fined for in sentencing?
Up to £5,000 in magistrates.
What is discharge?
Where the conviction appears on the persons criminal record, can be conditional or absolute.
What can be aggravating factors affecting sentencing.
- Mandatory
- Racist
- Sex/Gender
- Repeat offence
- On bail while committing crime
- Weapon involved
- Vulnerable victims (kids etc)
- Drugs involved
- Sentimental value of damages.
What are aggravating factors?
Factors that depend on the amount of time, these factors will INCREASE your time in jail
What can be mitigating factors affecting sentencing.
- Plead guilty
- Show remorse
- Loss of control
- Old or young
