The Occupational Health and safety Act
…was passed by the Ontario Legislature and is enforced by the Ministry of Labour. Contravention of any of the statutes or regulations may lead to prosecution.
Competent person
- is qualified because of the knowledge, training and experience to organize the work and its performance
- is familiar with this Act and the regulations that apply to the work, and
- has knowledge of any potential or actual danger to health or safety in the workplace
Supervisor
means a person who has charge of a workplace or authority over a worker.
Worker
means a person who performs work or supplies services for monetary compensation but does not include an inmate of a correctional institution or facility who participates inside the institution or facility in a work project or rehabilitation program.
Workplace
means any land, premise, location or thing at , upon, in or near which a worker works.
Duties and Additional duties of a Supervisor
Supervisor shall ensure that a worker;
- works in the manner and with the protective devices, measures and procedures required by this Act and the regulations, and
- uses or wears the equipment, protective devices or clothing that the workers’ employer requires to be used or worn
A supervisor shall;
- Advise a worker of the existence of any potential or actual danger to the health or safety of the worker of which the supervisor is aware
- where so prescribed, provide a worker with written instruction as to the measures and procedures to be taken for protection of the worker
- take every precaution reasonable in the circumstances for the protection of a worker
A worker shall
- work in compliance with the provisions of this Act and the regulations
- use or wear the equipment, protective devices or clothing that the workers’ employer requires to be used or worn
- report to his or her employer or supervisor the absence of or defect in any equipment or protective device of which the worker is aware and which may endanger himself, herself or another worker
- report to his or her employer or supervisor any contravention of this Act or regulations of the existence of any hazard of which he she knows
No worker shall.
- remove or make ineffective any protective device required by the regulation or by his or her employer, without providing and adequate temporary protective device and when the need for removing or making ineffective the protective device has ceased the protective device shall be replaced immediately
- use or operate any equipment, machine, device or thing or work in a manner that amy endanger himself, herself or any other worker
- engage in any prank, contest, feat of strength, unnecessary running or rough and boisterous conduct
Preservation of Wreckage - Where a person is killed or os critically injured at a workplace, no person shall…..
except for the purpose of;
- saving life or relieving human suffering
- maintaining an essential public utility service or a public transportation system
- preventing unnecessary damage to equipment or other property
interfere with, disturb, destroy, alter or carry away any wreckage, article or thing at the scene of or connected with the occurrence until permission to do so has been given by an inspector.
Penalties for contravention of the act.
Every person who contravenes or fails to comply,
-a provision of the is Act or the regulations
-an order or requirement of an inspector or a Director
or
-an order of the Minister
is guilty of an offence and on conviction is liable to a fine of not more than $25,000 or to imprisonment for a term of not more than 12 months or both.
Gasoline engines on mobile or portable equip. shall be refuelled
-outdoors
-with the engine on the equipment stopped
-with no source of inanition, within three meters of the dispensing point
and
-with an allowance made for expansion of the fuel should the equipment be exposed to a higher ambient temperature.
Where a structure is damaged to the extent that a collapse of the structure or any part of the structure is likely to occur and cause injury to a worker
-the structure shall be braced and shored to prevent the collapse of the structure
or
-effective safeguards shall be provided to prevent access to the area
bracing and shoring or other safeguards ….shall be installed progressively to ensure that a worker installing the bracing and shoring or other safeguards is not in danger.
A portable ladder shall
- be free from broken or loose members or other faults
- have non-slip feet
- be placed on firm footing
- where it exceeds 6 m and is not d=securely fastened or is likely to be endangered by traffic … be held in place by one or more workers while being used
- when not securely fastened, be inclined so that the horizontal distance from the top support to the foot of the ladder is not less than 1/4 and not more than 1/3 of the length of the ladder.
A worker required to wear or use any protective clothing, equipment or device shall be
-instructed and trained in its care and use before wearing the protective clothing, equipment or device.
A worker exposed to the hazard of head injury
