265 closure of premises by order
If a riot occurs or RGTB that a riot may occur.
A District Court Judge or 2 or more justices or 1 or more community Magistrate may at the request of a constable order every licensee in or within a specified distance to close for the sale of alcohol during the time specified in the order. The time must not be later that 24 hours from the end of the day which the order was made.
A constable may use any force necessary to close the licensed premise.
Licensee if breaches the order maybe be fined 10K and have licence suspended for a period not exceeding 7 days.
3K fine for a person who sells alcohol during that period.
Section 266 licence premise closure by police
- RGTB a riot may occur on licence premise
- RGTB fighting disorder is/will occur
- Threat to public health or safety
- Conduct amounts to public nuisance
- RGTB 5 year plus offences have and further will be committed
A constable may order the closure for a time not later than 24 hours from the end of the day that the order was made.
Once order is made a licensee may apply to Judge, justices or magistrates for revocation or the order.
10 K fine
7 day suspension of licence
3k fine for selling alcohol
267 Powers of entry licensed premise
Constable or inspector may enter any licensed premise to ensure they are complying.
Enter at anytime RGTB an offence is being committed.
Require licence, records etc
Require licensee or manager to provide any details etc
2K fine if refused or delays entry and doesn’t provide information.
269 Power to demand details
- RGTS committing an offence under this act can demand particulars.
- RGTB information is false. Require a person to provide satisfactory evidence.
- May be arrested with out warrant if refuses.
- 2K fine
