Section 86 Evacuation of premises and places
If a state of emergency is in force and in the opinion of a controller or any constable the action authorised by this section for the necessary prevention of Human Life that person or person authorised by him or her may authorise the evacuation of any premises, place or public place or the exclusion of persons or vehicles from any premise or public place.
Section 87 Entry on Premises
While a state of emergency is in place a controller or constable or anyone authorised may enter on and break into any premises if he or she believes on reasonable grounds it’s necessary to:
- Save life, prevent injury, rescue
- Permitting or facilitating the carrying out of any urgent measure for the relief of suffering or distress.
Section 88 closure of roads
If a state of emergency is in force a controller or constable or someone under their authority or anyone relevant in a civil defence emergency plan may in order to prevent the emergency totally or partly restrict any road or public area, with or with out vehicles to any public place within the area of emergency.
Section 89 removal of aircraft, vessels, vehicles etc
If a state of emergency is in force a controller, constable or person authorised may remove any vehicle etc or break into them for any reason deemed necessary.
Section 90 Requisitioning powers
If a state of emergency is in force and a controller, constable or person authorised may direct the owner of in control of any land, vehicle, boat etc to immediately place that body requisitioned property. ( Demand use)
Must provide a written statement specifying the property that is requisitioned.
Section 91 Power to give directions
- State of Emergency is in force a controller or constable or person authorised may direct any person to stop any activity that may contribute to the emergency or request a person verbally or in writing to take any action to prevent or limit the extent of the emergency.
- Direct the owner of a structure or owners agent to obtain an assessment on the effect of the emergency on the structure. Can only give direction if in the circumstances it poses a risk of injury or risk to life.
Must state:
- The purpose of the assessment
- Reasonable time within which the assessment can be concluded
- Must give a copy to the person who gave the assessment
Owner may appeal district court that it was unreasonable.
Section 92 Power to Carry out inspections
State of emergency is in force a controller or constable or anyone authorised may examine, mark, seize, sample, secure, disinfect or destroy and property or animal to prevent or limit the emergency.
Section 93 Person Exercising power to produce proof of ID
- have with it produce evidence or ID
- Explanation of authority which they’re acting under and the powers he or she is exercising
Section 95 Failure to comply with requirement civil defence emergency plan

Section 104 - penalty
A person who fails to comply or obstructs during civil defence emergency is liable to:
- 3 months imprisonment 5 K fine (individual)
- 50k fine body corporate
Designated incident controller should not be given control until
- Establish and incident and control point
- Familiarise themselves with the incident and obtain a briefing
- Formulate a response plan
6 steps sequence of information
- Summary of the incident including weapons
- Time Delay
- Direction of travel
- Mode of travel
- Description of offender/vehicle
- Other info eg hazards/weapins
