A
  • Whoever, being armed with an offensive weapon or instrument, or in company of another
    person;
  • Robbs or assaults with intent to rob or,
  • Stops any mail, or vehicle, railway or person with intent to rob

SCENARIO

You are the first investigator to arrive at the scene of an armed robbery at a local bank.

  1. What do you do when proceeding?
A
  • Obtain all possible info from VKG (POI/VOI/Descriptions/weapons/loc etc)
  • Ensure some vehicle attend the scene whilst others circulate and potentially setup perimeter
  • Avoid use of sirens on approach
  • Comply with directions from VKG
  • On approach, look for getaway vehicle, offenders and movements of persons outside location
  • Look for cover/concealment positions in case offenders are still inside
  • If offenders inside – consider contain and negotiate. Immediately advise VKG. TOU/NEGS activated
  • If offenders have left, enter and identify any vics/witts and need for medical assistance

The offenders are not at location. What do you do?

A
  • Enter and identify hazards or dangers.
  • Identify any witnesses/victims. Check if medical assistance is required. Obtain details.
  • Circulate information re descriptions/directions of POI/VOI
  • Consider Polair/Dog Squad
  • Establish Crime Scene (Entry/exit point)
  • Secure crime scene with tape (inner/outer perimeter)
  • Allocate officer to guard maintain log
  • Ensure forensic evidence is not disturbed
  • Arrange crime scene examination
  • Notify supervisor/DO
  • Separate vics/witts

What are your considerations?

A
  • Consider that VOI may have been abandoned
  • If located with offenders inside, consider officer survival skills/dangerous vehicle stop. Notify VKG
  • If located unattended:
  • Establish crime scene
  • Notify VKG
  • VOI needs to be searched/forensically examined
  • Canvass for CCTV, witts, escape routes etc.

What are your steps of investigation?

A
  • Secure CCTV including days prior
  • Statements from vics/witts (separated so no contamination)
  • Canvass surrounding area for CCTV, witnesses, discarded physical evidence
  • Maintain Crime Scene. Ensure CS attendance and examination
  • Consider specialist police – e.g. ballistics, dog squad
  • Notify Robbery and Serious Crime Squad
  • Liaise with intelligence officers
  • Ensure all exhibits are seized, recorded correctly and forensically examined
  • Getaway vehicle examination
  • Identify escape routes (bus/train)

  • Don’t release sum of money or details of vics/witts
  • When releasing info, consider descriptions to avoid disposal of items

What is the proofs for Robbery?

A

1) The accused robbed or assaults with intent to rob any person or,
2) Steals any chattel, money or valuable security from the person of another
3) The elements of assault + larceny

Assault = Accused used either or both a forcible or hostile act to the victim without consent
Larceny = Accused took/carried away, property belonging to another, without consent, dishonestly, without claim of right with intent to permanently deprive

3 cont.) There must be unlawful taking and carrying away of property with intent to permanently deprive.
Property must be taken by actual violence or by putting owner in fear of actual violence.
