Minor
Also referred to as an Infant, a person who under the age of majority, usually meaning under age 18. Someone who is not an adult.
Guardian
A person or entity appointed to look after a person. A guardian of a person.
Conservator
A person or entity appointed to look after a person’s assets. A guardian of assets.
Guardian ad Litem
A court appointed person to serve as an advocate, usually for a child, and to act in the best interest of that child during a specific hearing or specific litigation.
Attorney-in-fact
One who stands in place of another. The person appointed to act for a person who executes a Power of Attorney.
Necessities
Things that are considered indispensible to life, usually meant to be food, clothing and shelter.
Emancipation
A declaration that a minor is no longer under the care of custody of parents or a guardian.
Restitution
The return of something to the owner of it or to the person entitled to it. The act of making good or giving equivalency for any loss or damage or injury.
Ratify
To validate a contract after its execution.
Express Ratification
To expressly state or write one’s intent to honor a contract.
Implied Ratification
Ratification to honor a contract that is inferred from a party’s behavior , words and action.
Intoxicated
Under the influence of alcohol or drugs.
Cognitive Test
Mental incompetence determined by one’s inability to understand the overall nature and consequences of a transaction.
Volitional Test
Mental incompetence determined by one’s failure to act reasonable with respect to a particular transaction.
Adjudicated incompetent
A court’s determination that one is incompetent and cannot act in their own best interest.
