Define Standard of Care
The average degree of skill or care provided by similar members of the same profession. Care must not fall below these basics.
Examples of Standard of Care
1 - Providing appropriate referrals or consultations when needed

5 - Gathering info on personal or medical history

Steps taken after Tarasoff criteria is met
1 - Warn victim
2 - Warn someone who can warn victim (if can’t get ahold of them)
3 - Have CT dispose of the means (knife, gun, etc)
4 - No violence plan
5 - 51/50 hold
6 - Call police
7 - Additional reasonable caution (increase sessions, medical consult, anger management, etc)
HIV/AIDs — Does this trigger Tarasoff
No. TH cannot break the confidentiality of their CL if they hear that CL wants to infect others intentionally. This is because of an overlap with HIPPA and the medical profession.
When does “Duty of Care” begin?
When the CL and the TH decide to work together and enter a “special relationship”. This can be after the first few sessions, especially if the CL is shopping around. The exchange of money doesn’t count. Signing consent forms doesn’t count.
When does “Duty of Care” end?
At termination.
Define Duty of Care
The agreement of the therapeutic relationship between CL and TH. Acknowledgement of “special relationship” between CL and TH.
Define Scope of Practice
The limits of what care therapists can offer across their field. This is defined by the state and is not expandable unless you receive another license.
Define Scope of Competency
The limits of what care a therapist can provide are determined by their specific experience, education, and training. This is expandable through continuing education.

When a CL discloses a sexual relationship and/or behaviors with a prior TH
