framework for safeguarding the welfare and managing finances of adults who lack capacity due to mental illness or learning disability
adults with incapacity
a way of giving someone else permission to make decision about your money, property aswell as your health and personal welfare
can only be granted if they have capacity
power of attorney
where somebody can act on anothers behalf and can cover financial and or welfare matters when a person does not have capacity to make decisions and therefore cant appoint attorney to act for them
guardianship
allows you to be held in hopsital for up to 72 hours for assessment
only Fy2 or above can do it
there is no appeal against it
emergency medical detention certificate
should be the usual route into hospital and has to be agreed by psychiatrist and mental health officer
short term detention
set rule regarding treatment that you must comply with whether its in the hospital or community
mental health officer has to apply for and a tribunal is held
compulsory treatment order
helps you get your voice and opinions heard about your treatment
independent advocacy
someone to help protect your interests
if over 16 you can choose
if under 16- its the parents
named person
if the police think you have done something wrong then you could go to court
police can ask the doctor to examine you
criminal procedure act
criteria for detention
has mental health disorder likely to harm self or others if not detained impaired judgement urgent treatment is necessary if short term detention cant be done its the least restrictive option

short term detention
admission for assessment up to 28 days
requires MHPO consent and not renewable

compulsory treatment order
admission for treatment for up to 6 months
can be renewed
tribunal has to be held-lawyer, doctor , social worker/ nurse

emergency detention
held for upto 72 hours
dont need MHO but its best practice

a voluntary patient in hopsital can be detained by a doctors for 72 hours

a voluntary patient in hospital can be detained by a nurse for 6 hours
