What are CDM Requirements
- Applies to all construction work
- Three duty holders (Client, designer and contractor)
- If over 500 work days or 20 men for 30 days then HSE is to be notified.

What would be your actions if you found a property to be in poor repair from tenants?
- Approach with the tenants in the first instance to understand the issues
- Refer to tenancy agreement for repairing obligations
- Complete report stating works required and report to the client
- Action appropriate works and recharge if nessecary
When must a notice under s.24 to s.28 be served on a commercial tenancy?
- 14 Days before tenancy commences
Why was the Homes Fitness for Human Habitation Act introduced?
- To stop rouge landlords offering and maintaining poor quality living spaces to tenants
When did the Homes Fitness for Human Habitation come into force?
- March 2019 for all new leases
- March 2020 for existing leases
What are the 29 Hazard categories of the housing health and safety rating system?
Cant name them all but some include;
- Damp and Mould Growth
- Excess cold
- Excess Heat
- Asbestos
- Lead
- Radiation
- Electrical Hazards
What is the Homes Fitness for Human Habitation Act 2018?
A law that requires all landlords in England to maintain their properties so that they meet the minimum standard for human habitation
What is the criteria for Fitness for Human Habitation?
The court will decide on matters set out in Section 10 of the Landlord and Tenant Act 1985 including;
- the building has been neglected and is in bad condition
- The building is unstable
- There is a serious problem with damp
What are the penalties for non-compliance under the Fitness Human for Habitation Act?
Courts may require one or both of;
- Compulsory improvement to the condition of the property
- Compensation to the tenant at the discretion of the judge.
What are non CDM works?
- Providing quotes
- Surveys
- Electrical Inspections and testing
- Chimney sweeping
What act was amended to introduce Homes fitness for Human Habitation?
The Landlord and Tenant act 1985
What exemptions do Landlords have under the Homes fitness for Human Habitation Act?
Landlords do not have to remedy unfitness when;
- The problem is caused by tenant behaviour
- Problem is caused by Act of God
- Problem is caused by tenants own possessions
- Landlord is unable to get consent for the works
- The tenant is not an individual
Are MEES applicable to Farmhouses?
Grey Area in legislation
- Suggests that houses let under and FBT are exempt from domestic MEES
- Best practise to obtain one but not a requirement.
What are the different levels for listed buildings?
Grade 1 - Buildings of the highest significance
Grade 2 - Buildings of special interest
Garde 2* - Buildings of particular importance and of more than special interest
