What is CDM?

A

Construction and Design Management comes under the Construction (Design & Management) Regulations 2015.

CDM governs the way construction projects of all sizes and types are planned in the UK.

When does CDM apply?

A

Simple projects ie one contractor doing small repairs do not need CDM

Complex - larger repairs where more than one contractor is engaged

If work is to last more than 500 days or 300 days with 20+ contractors HSE may need to be informed

A

Damp gradually coming through walls and floors

It occurs from ground water travelling upwards through building materials

A

Condensation is caused by moisture in poorly ventilated rooms

Common causes are not ventilating during cooking or bathing

A

A

A

A

The Housing (Scotland) Act 1987 for T, and 2006 for R. However, there has been recent updates

What’s an EPC? Are they needed for all properties?

A

Energy Performance Certificate – depends on the size, if v small then don’t need one – 10 years valid – need up to date one to start a tenancy

A

signed lease, copy of the EPC, EICR, PAT (if required), RoC – inventory, boiler service stuff, gas safety stuff

48 hours, and not necessary if emergency

A

interlinked heat and smoke, CO – common spaces, landings, halls – CO needs to be in the room where there is a open fire/gas stuff and upstairs room if chimney

A

Occupiers name is, rent, what it is, address of prop, landlord details (landlord reg), start date, repair – who does what

A

no rental with this - the licensee is granted permission to use all or part of the property on a non-exclusive basis

A

to make sure the tenant isn’t breaching the lease, if there is any repairs needed

A

short assured tenancy – are before dec 2017 – AT5 for the start and AT6 for end – fixed terms. Housing Scotland act 2006

How do you bring a SAT to an end?

A

LL – eviction notice s.33 notice, Tenant – 40 days notice in writing

What’s the rent review process of a property under a PRT?

A

Your landlord can put your rent up any time in the first year of your tenancy, and once every 12 months after that. They must send you a rent-increase notice at least 3 months in advance of the change.
