A

The owner may seek one or more of the following remedies:

1) Court order requiring Association to produce resale;
2) Judgment against the Association not greater than $500.00
3) Court costs and attorney’s fees.
4) Judgement for $500 and court costs and attorney’s fees may be deducted against assessments.
5) Owner may provide affidavit to purchaser that after two requests the Association did not provide the resale.

These are the sole remedies available to the owner. The Association bears no other liability to the owner for failure to deliver a resale.

What is the buyer’s remedy for a POA failing to deliver a resale certificate after a 2nd request has been made and the owner has provided the buyer an affidavit stating such?

A

1) Purchaser/lender/title company is not liable for any money due the association on the property that accrued prior to the date the affidavit was prepared; and
2) The POA’s lien to secure the amounts due on the owner’s property shall automatically terminate.
