SCOTUS ruled it was unconstitutional to civilly commit a prisoner at the end of their sentence without a full judicial hearing and review
violation of due process rights and the same rights should be afforded to prisoners as would be to civilians who were being committed
Estelle v Gamble
prisoner said he didn’t get adequate care for his back injury
SCOTUS ruled that he did and established the “Deliberate Indifference” Standard
Rogers v Okin
Boston State Hospital class action lawsuit regarding forced medication and seclusion
Ruling: both prisoners and competent mental health patients have a right to refuse medication - need a judicial hearing to force meds
Vitek v Jones
SCOTUS held that prisoners are entitled to an administrative hearing to determine the need to transfer to a psychiatric facility during their prison sentence.
Gave prisoners additional rights but not as many as civilians would get.
Also, just required that prisoner is seriously mentally ill and the treatment available in prison isn’t sufficient
Jones v U.S.
SCOTUS ruled that people found NGRI can be committed until they are deemed no longer dangerous.
NGRI is a civil process not criminal
U.S. v Salerno
Involved the Genovese crime boss being detained before his trial
SCOTUS said it was ok to detain a person per the Bail Reform Act if they are considered a danger
Washington v Harper
Court held that the reasonable professional judgment review of involuntary medication of prison inmates was constitutional
Farmer v Brennan
trans inmate won lawsuit because the prison showed deliberate indifference in putting her in gen pop - she was raped and beaten
