What is a claim form?
‘particulars of claim’
at the same time pay a court fee depending on how big the case is.
What does served on the defendant mean?
-a court official delivers claim by hand… they then have 4 options
What are the 4 options after the defendant is served?
-settle
-ignore
-defend- within 14 days
-counter-claim
What does settle mean?
The defendant pays the full amount and the case is over.
What happens when a claim is ignored?
After 14 days the claimant wins by default.
What is the allocation questionnaire?
Decide which track the case will go through- judge then will pick out a suitable track.
What happens after the allocation questionnaire?
The trial.
