Practical Completion can only occur if:
A
- contractor has complied with duty to provide as-build drawings and info for health and safety file
- all construction work agreed to be done must be complete
- BUT CA can certify if the left over items are very minor
- works CAN be complete if defects are latent (unknown)
- works can NOT be complete if defects are patent (known)

Why is it bad practice to certify if you know there are issues with the works?
A
Because the rectification period is supposed to cover any issues that aren’t apparent at practical completion

Risks of issuing PC too early?
A
- employer has reduced leverage to convince contractor to finish work
- CA is in breach of their duty of care
