What does a relevant event mean?
If a delay is due to an event specified in contract (cl 2.29) then contractor is entitled to additional time - as decided by the CA/architect.
What generally counts as a relevant event under cl 2.29?
Type 1 - employer is liable for these events:
- variations
- architect’s instructions
- antiquities
- deferment of possession
- approx. quantities that are not an accurate forecast
- suspension of contractor’s obligations
- impediment, prevention or default of employer
Type 2 - neutral - no liability
- delay by statutory undertaker
- exceptionally adverse weather conditions
- loss or damage occasioned by a specified peril or perils
- civil commotion or terrorism
- strikes
- act of Government
- force majeure
what does cl 2.6 allow?
allows employer to occupy site if contractor agrees and if insurers have been notified.
what does cl 2.7 refer to?
work outside the contract which employer intends to carry out: CHECK -DOESNT SOUND RIGHT
1 - if contract allows/provides for the work then contractor should permit work to happen
2 - if contract doesn’t discuss the work then if the contractor agrees and insurers are notified the employer can arrange the work
