What is S32 of the Fire Service Act 75
Police must co-operate with the person in charge of the Fire Service at a fire or suspected fire or other fire service led emergencies
The person in charge of the Fire Service at a fire is charged with the direction of operations S28 of the Fire Service Act 1975 refers. List the powers in this section
- S24(4)(b) FSA 75: enter private property when it is on fire or endangered, or when entry is essential to performing a necessary duty
- S24(4)(h) FSA 75: close roads
- S28(4)(i) FSA 75: remove vehicles impeding the Fire Service. If necessary, they can break into the vehicles for that purpose
- S28(4)(j) FSA 75: remove people who are in danger or interfering with operations, using reasonable force if necessary
- S28(4)(n) FSA 75 do anything else that is reasonably necessary for the protection of life and property
Use of Fire Service powers by Police
When can Police exercise these powers, whilst the fire is being fought?
S32(2) FSA 75 Police may exercise these powers if called upon to do so by the member of the Fire Service in charge of the fire.
Caution: Police officers have no right to exercise these powers simply because they are present at a fire
