Section 32 - what are Identifying particulars?
Biographical details (name, address and DOB)
Photo or visual image
Finger/palm and foot prints
How must you take a persons identifying particulars
In a reasonable manner given the circumstances
May use reasonable force to secure the identifying particulars
S 36 - care and protection of intoxicated people.
Can detain and take into custody under what circumstances?
The constable believes
- Incapable of protecting themselves from physical harm
- Likely to cause physical harm to another
- Likely to cause significant damage to property
And it is not practicable to provide for a persons care at their place of residence or at a temporary shelter
A person detained for intoxication must be
Released as soon as intoxication ceases
Must not be detained for longer than 12 hrs unless a doctor recommends further detaining for not more than another 12 hrs
Policing Act 2008 “Intoxicated”means
Observably affected by alcohol, drugs or substances to such a degree that speech, balance, co-ordination or behaviour is clearly impaired
Policing Act 2008 - what does temporary shelter mean
Place (other than a place operated by police) that is capable of providing care and protection of an intoxicated person
What must be satisfied for a doctor to authorise further intoxicated detention
- Remain intoxicated and can’t protect themselves
- Does not have any medical needs that require medical attention
- Not practical to provide for care at their place or a temp shelter
