Hazardous Substances and New Organisims Act

Question 1

Hazardous substance means

Answer 1

Any substance which has the following intrinsic properties

Explosiveness
Flammability
Capacity to oxidise
Corrosiveness
Toxicity
Eco toxicity

Or

On contact with air or water generates the above

Question 2

Emergency Means

Answer 2

Actual or imminent danger to human health or safety

Or

Danger to the environment or chattels so significant the action is required to remove the danger

Arising from a hazardous substance or a new organism

Question 3

Enforcement officer

Answer 3

Any constable, employees, volunteer or contractor of FENZ

Question 4

Declaration of an emergency

Answer 4

When an enforcement officer has reasonable ground to believe their is an emergency and

• no state of emergency
• not being dealt with under the FENZ act
• no emergency under the bio security act
• no other emergency in effect

AND

Powers required to

• enter premises or dwelling or
• remove the cause of emergency or
• stabilisation of the issue to prevent adverse effects
• protect safety of people, chattels etc

An enforcement officer may declare a hazardous substance or new organisms emergency.
