What does s32 allow Police to do?
Enables police to obtain information to be used now or in the future for any lawful purpose
Where can identifying particulars be obtained?
At a Police station or any other place being used for police purposes
What are identifying particulars? (s32 & s33 (summons))
Biographical details ie: name etc
Photograph or visual image
Fingerprints, palm prints or foot prints
s36 Policing Act 2008
When can you detain an intoxicated person?
Reasonably believe that:
Incapable of protecting themselves from physical harm
Likely to harm another person
Likely to damage property
And it s not reasonable to take the person home or to a temporary shelter
When must a person detained under s36 be released?
As soon as they cease to be intoxicated
After 12 hours
Meaning of intoxicated?
Observably affected by alcohol drugs or substances to a degree that speech, balance, coordination or behaviour is clearly impaired
