Time frame for VVS?
No later than 2 weeks after the family harm episode
2 things you must do if evidential sufficiency to prove a breach of PO
- charge the offender
- not release on police bail for 24 hours (unless to court)
Who can issue a PSO?
A qualified constable (substantive Sgt or above)
What are the immediate effects of a PSO?
Require bound person to:
- surrender any weapon in their control or f’arm licence
- vacate any land or building occupied by a person at risk
- provide cooling down period. (Seek assistance)
PSO effect on parenting orders?
Parenting order is suspended
When can’t a PSO be issued?
If the person posing the risk is under 16 yrs old.
When are PSO’s issued for longer than 5 days?
In situations where there is a likelihood of serious harm occurring
Police powers pending authorisation and issue of a PSO?
Detain the person for up to 2 hours
Remove the person from the premises and to a Police station
What should an issuing officer do ideally while still at the scene?
Contact a family harm support agency as part of the frontline safety plan
Special circumstances for issuing a PSO to a 16 or 17 year old?
Necessary to make a person at risk safe
Level of concern in On duty is High
Approval from a Snr Sgt or above
Snr Sgt has consulted with OT

Respondent holds a f’arm licence
