s40 Arms Act 1983
Who must give particulars?
Every person in possession of a firearm shall on demand give their name, address and DOB to Police
s66 Arms Act 1983
Possession
Occupier of land, building or vehicle deemed to be in possession of f’arm unless they prove it is not their property and it was in possession of some other person
Circumstances allowing search and seizure for firearms and s18 S&S
Breach of the arms act
By physical or mental condition is
- incapable of proper control
- may kill or cause bodily injury
PO or PSO is in place or grounds for a PO
Police responsibilities when firearms are carried
Advise immediate supervisor and comms
Deploy with a taser where available
Lawful purposes fr using a firearm
s48 Crimes Act (defence of self or other)
s39 Crimes Act (effect arrest)
s40 Crimes Act (prevent escape)
When can a warning shot be fired?
Should not be fired. However…
Offender has been asked to surrender and it can be clearly aimed as a warning shot
4 steps after a discharge involving injury or death?
Take control of the scene
Ensure first aid is rendered
Manage the scene
Inform the district commander
When to submit a TOR for firearms?
Presentation
Discharge
Unintentional discharge
Destruction of animals
Who must submit a TOR for a Police shooting?
A supervisor (not the person who used the force)
Supervisors action after TASER use
Attend scene
Ensure aftercare/medical attention
Scene is preserved/ photographed, evidence is collected
Subjects are examined by a Dr
Operator completes taser register and submit TOR
Review TASER footage and TOR
