A

A constable may conduct a search BEFORE taking the person to a police station
Without obtaining an authorisation from an inspector
IF
The presence of that person is necessary for an effective investigation

Section 19 - PACE 1984

A

Power to seize property while LAWFULLY ON PREMISES

a constable may seize anything which is on the premises
IF he or she has RGB
that it has been obtained in consequence of the commission of the offence, that it is evidence in relation to an offence which he/she is investigation
OR
any ither offence and that it is necessary to seize in order to prevent it being:

C - Concealed
L - lost
A - altered
D - damaged
D - destroyed

Section 18(1) - PACE 1984

A

Inspectors authority
A constable may enter and search any premises OCCUPIED or CONTROLLED by a person under arrest for an INDICTABLE offence, provided they have RGS that there is evidence relating to THAT offence
OR
another indictable offence which is CONNECTED or SIMILAR to that offence

Section 22 - PACE 1984

A

Retention of seized property

Seized property to be retained for as long as necessary

  • use as evidence in trial
  • forensic examination
  • further investigation (unless copy would suffice)
  • establish lawful owner

*Property shall not be retained if a copy or image would be sufficient
