61.3 Requirement for certificates, ratings, and authorizations.
To act as the PIC you must have:
1) Valid pilot certificate in your physical possession or readily accessible in the aircraft
2) Valid photo ID in your physical possession or readily accessible in the aircraft
1) Valid Driver’s License 2) Government ID Card 3) Military ID
4) Official Passport
5) Other form of ID that the Administrator finds acceptable
3) Current and appropriate Medical Certificate. At least a Class II to serve as a
commercial pilot.
61.15 Offenses involving alcohol or drugs.
Any violation involving drugs or alcohol will result in:
1) Denial of application for any certificate, rating, or authorization issued under this part
for a period of 1 year after the date of final conviction; or
2) Suspension or revocation of any certificate, rating, or authorization issued under this
part
Example violations: Anything involving the growth, transportation, possession, or distribution of drugs. Violation of 91.17. Two DUIs/DWIs within 3 years. Failure to notify the FAA in writing of any motor vehicle violation involving drugs or alcohol within 60 days of the action.
61.16 Refusal to submit to an alcohol test or furnish test results.
A refusal to submit to a blood alcohol test or breathalyzer test to determine compliance with 91.17 results in the same disciplinary action as a violation of 61.15
61.17 Temporary certificate.
Issued for up to 120 days.
Certificate expires:
1) On the expiration date shown on the certificate
2) Upon receipt of the permanent certificate
3) Upon receipt of a notice that the certificate or rating sough is denied or revoked.
61.19 Duration of pilot and instructor certificates.
No expiration for Pilot Certificate. Just need to comply with 61.56
When request by the FAA you must surrender a suspended or revoked certificate.
61.23 Medical certificates: Requirement and duration
Commercial Pilots:
Class I - Valid for commercial operations for 1 year. Good for 6 months as a Class I (ATP). Then becomes a Class II for 6 more months.
Class II - Valid for commercial operations for 1 year. Expires on the last day of the month, 12 months after the date printed on your certificate.
61.25 Change of name.
Application to change the name on your certificate must be accompanied by:
1) Your current certificate; and
2) A copy of the marriage license, court order, or other document verifying the name
change.
61.29 Replacement of a lost or destroyed airmen or medical certificate or knowledge test report.
Notify FAA. FAA will fax you a paper copy that is good for 60 days.
61.53 Prohibition on operations during medical deficiency.
Cannot serve as PIC if:
1) Pilot knows or has reason to know of any medical condition that would make the
person unable to meet the requirements for the medical certificate necessary for the
pilot operation; or
2) Is taking medication or receiving other treatment for a medical condition that results
in the person being unable to meet the requirements for the medical certificate necessary for the pilot operation.
61.56 Flight Review
Biannual flight review.
Consists of a minimum of 1 hour of flight training and 1 hour of ground training. The review must include:
1) A review of the current general operating and flight rules of part 91; and
2) A review of those maneuvers and procedures that, at the discretion of the person
giving the review, are necessary for the pilot to demonstrate the safe exercise of the
privileges of the pilot certificate.
Flight Review must be completed every 24 months. Requires a logbook entry or documentation in your 135 Pilot Record. Annual 135 checkride satisfies this requirement. A checkride for your ATP would also satisfy this requirement.
61.57 Recent Flight Experience: Pilot in Command
Cannot serve as PIC in an aircraft carrying passengers unless: 1) 3 Takeoffs and 3 Landings were conducted in the last 90 days.
2) These takeoff and landings were conducted in an aircraft of the same category,
class, and type (if a type rating is required).
3) For night currency these takeoff and landings were conducted between 1 hour after
sunset and 1 hour before sunrise.
61.60 Change of address.
You have 30 days to notify the FAA if you change your permanent mailing address. You can do this on the FAA.gov website.
