Incest
Section 130 Crimes Act 1961
Birth and adopted parents are considered: parents. Where one spouse adopts and the other consents, the consenting spouse is not a adoptive parent.
Step parents are not parent child.
Sexual conduct with a dependant family member
Consent is not a defence.
Dependant family member cannot be charged.
Power or authority over dependant person required.
Meeting young person following sexual grooming
Offence is directed primarily towards “grooming” on the internet. The section does not criminalise grooming due to infinite number of guises.
Offence is completed when parties meet, or the defendant travels or makes arrangements to meet with the relevant intent. To be intentional, the meeting only needs to be purposely arranged.
