Purpose of the Arms Act 1983
- Regulate the use of firearms
- Provide a licensing system
- Gives police powers to seize
- Establish offences
Definition of ‘Firearm’
Anything from which any shot, bullet, missile or projectile can be discharged by force of explosion
Examples of ‘Prohibited Firearm’
- Semi automatic (except pistol)
- A pump-action shot gun with a detachable magazine
- A pump-action shotgun capable of holding more than 5 cartridges
Rules of Under 16’s in regards to firearms
Cannot own a firearm or air gun but can use one if supervised by licence holder
Rules of 16-18 year old’s in regards to firearms
Require a licence for both firearms and air guns
Rules for 18+ in regards to firearms
Require a licence for firearms but not air gun
Explain the different categories for firearms licences
Category A: Full licence (not pistols or restricted)
Category B: Pistols (only when members of pistol clubs)
Category C: Collections, restricted weapons or theatrical performances
Category D: Dealers
When does someone have ‘Possession’ of a firearm?
- Knowledge of the firearm
- Physical control of it
Explain Section 40 of the Arms Act 1983
40 (1): Power to demand particulars from anyone in possession of a firearm. Name, DOB, Address
40(2): Refusal to give particulars = caution then arrest
Explain Section 18 Search and Surveillance Act 2012
Power to search and seize any firearm.
Reasonable grounds to suspect
Person/Bag/Property/Vehicle
Obligations when using a warrantless search or entry power?
- Comply with 125 and/or 131
- On line notification: 169 report required by end of
shift
Legal requirements firearms licence holders must adhere to?
- Keep their licence legible
- Produce it to Police on demand
- If they don’t have it, must produce it at Police Station
within 7 days - Change of address must be notified within 30 days
- Must report theft, loss or destruction in writing to
Police. - If death or injury result from use of firearm must
report ASAP
Definition of ‘Carries’
Actually has the weapon on them
What semi automatic weapons are NOT prohibited?
- 0.22 cal or lower 10 bullets max
- semi-auto shotgun with non-detachable mag and 5 bullets max
