Duty of police in regards to licencing?
- Provide vetting services
- Enforcing provisions of the Act in relation to licensees, managers, staff and patrons
- Enforcing the offence provisions of the Act where alcohol is being sold, supplied or consumed
What 2 offences occur with minors on licensed premises?
- Minors found in restricted or supervised area (244)
- Minors purchasing alcohol (243)
Exemptions to minors being in supervised or restricted areas..
- Preparing and serving meal
- Serving alcohol
- cleaning/ repairing etc
Does not include entertainers
When do you have power to enter a premise?
Section 267
- To ascertain if the Licensee is complying with the Act
- Reasonable grounds to believe an offence has been or is being committed
What information can you demand from people after entering premise?
- Name
- DOB
- Address
Under what circumstances can you close a premise?
- Riots
- Fighting/serious disorder
- Significant threat to public safety
- Substantial public nuisance
- Reasonable grounds to believe offences have been committed and significant risk of offences continuing
When can Police remove an intoxicated person from a public palce?
If they are…
- incapable of protecting themselves
- likely to cause physical harm
- likely to cause damage
What does SCAB stand for?
Speech, Coordination, Appearance, Behaviour
Definition of Intoxication.
Where a person is observably affected by alcohol, other drugs or other substances to such a degree that 2 or more of SCAB are evident
What rights does a person have that has been detained for intoxication?
- Caution rights
- If detained at a police station allowed to make a phone call
- Released as soon as sober
List ‘Alcohol offences in public places’
- Under 18 drinking
- Under 18 possession for consumption
- Drinks, supplies, offers, in possession on public transport
