What happened in Clegg(1995)?
A soldier shot at a car driving towards him, killing a passenger. He was guilty of murder as he fired the last shot after the car had passed providing no risk to the soldier at this point.
What happened in Gibbins and Proctor(1918)?
Gibbons and Proctor, neglected and staff Gibbons child victim died of starvation. They were both guilty of murder and had obligation to care for the child.
What happened in Malcherek and Steel ?
Both defendants caused the victim to get into extensive care where their life support was turned off. they were guilty of murder – death was when brainstem died, so doctors were not cause of death.
What happened in West(1848)?
A child who is injured in the womb, then born alive, but later dies, he is classed as a human being. The perpetrator is liable for homicide in the form of murder or manslaughter, but depending on whether they had intent to injure actual fetus.
What happened in Smith(1961)?
A policeman tried to stop a car, so the defendant drove away as the victim jumped on the bonnet. The victim fell off onto an oncoming car and died. guilty of murder as GBH was intended.

Defendant broke into a sweet shop and the beat the shopkeeper to death. Guilty of murder – intended to inflict GBH, so was implied malice..
