S44 mental capacity act 2005 - ill treatment or neglect

‘Subsection 2 creates a criminal offence of ill treatment or wilful neglect of a person lacking capacity, or who is reasonably believed to lack capacity, by anyone responsible for that persons care, donees of a lasting power of attorney, or an enduring power of attorney or deputies appointed by a court.’

‘If a constable finds in a public place to which the public has access, a person who appears to him to be suffering from mental disorder and to be in immediate need of care or control, the constable may, if he thinks it necessary to do so in the interests of that person, or for the protection of other persons, remove that person to a place of safety.’
