Describe section 4
Emergency detainment lasting 72 hours
Usually converted to section 2 on arrival to hospital
Can be used by GP, approved MH professional or nearest relative
Describe section 5(2) and 5(4)
For a voluntary inpatient who needs to be detained. Any ward except A+E.
5(2) completed by doctor, lasts 72 hours
5(4) completed by nurse, lasts 6 hours
What sections can a police officer use
135- police can break into property and move person to a place of safety
136- police can take person from public place to a place of safety
Which sections can patients appeal against
Section 2 in first 14 days
Section 3, once in 6 month period
How to assess mental capacity
Patient understands information relevant to decision
Can retain information long enough to make decision
Can weigh up information as part of decision making process
Communicate decision back
What should be done if lack of capacity is likely to be temporary
Reassess later
If decision can’t be delayed act as if no capacity
