Section 2
Relates to any person experiencing abnormal state of mind, either continuous or intermittent, to a degree that it poses a risk to safety
Section 8A
Application for assessment. Any person over 18, who has seen person in past 3 days can fill this and state their concerns
Section 8B
Medical Cert supporting 8A. Any medical practitioner can complete this. They must be no relation to person requesting 8A or person in question
Section 9
Assessment examination to be arranged and conducted. A DAO will make necessary arrangements
Section 10
Certificate of Preliminary Assessment. Medical practitioner shall record their findings from assessment, stating their decision
Section 11
The first period of assessment. Person is now legally defined as patient under MHA. They are under act for 5 days, cannot refuse treatment
Section 12
Certificate for further assessment. Examination by clinician to decide if the patient still has MH disorder and if they need further assess + treatment
Section 13
Second period of assessment + treatment. Legally defined as pt under MHA. Under act for a further 14 days
Section 18
The hearing. Takes place in family court, with family court and judicial judge. Pt can have lawyer or represent self. A report must be submitted by clinician as to why they need treatment
Section 29
Community treatment order. Requires pt to accept treatment in the community
Section 30
Inpatient treatment order. Requires pt in hospital, for purposes of treatment
Section 31
Leave requests for pts. For pt who are inpatient, where they may have hospital leave for a time not exceeding 3months
