How is a “Mental Disorder” defined?
Abnormal state of mind, characterised by delusion, disorders of mood, perception, volition, cognition of such degree that it - poss a serious danger to the health or safety of that person or others OR seriously deminishes the capacity of that person to take care of himself or herself
How is a “Special Patient” defined?
Detained by court order
- Criminally insane
- Unfit to plead
- On remand for a psychiatric report
How is a “Restricted Patient” defined?
Subject to a compulsory treatment order but are a present danger to the public
What is a “DAO”
Duly Authorised Officer, a qualified nurse who specialise in mental health and receive further training on an ongoing basis
Who may apply for another for another person to undergo a Compulsory Mental Health Assessement? (Compulsory Treatment Order)
Any person over the age of 18 years, normally doctor or relatives. Not appropriate for police to apply
What does Section 109 of the Mental Health Act 1992 refer to?
Gives us power to apprehend any person wandering at large in a public place AND behaving in a manner that gives us reasonable belief that they may be mentally disordered AND is in the interest of the person/public - Take them to DAO for examination
What does Section 110 of the Mental Health Act 1992 refer to?
Gives us power to assist a doctor (medical practitioner), to enter, detain and transport a patient for treatment/assessment - DAO has to accompany
What does Section 41 of the Mental Health Act 1992 refer to?
Gives us power to assist a DAO, to enter, detain and transport a patient for treatment/assessment - DAO to accompany
How long can you detain a mental health patient for?
6 hours
What Section of the Mental Health Act 1992 gives you the power to use reasonable force to transport a patient, enter the premise and detain a patient?

What happens when a Restricted Patient goes AWOL (absconds/absent without leave)?
They may be apprehended and returned to the hospital at any time
What happens when a Special Patient goes AWOL (absconds/absent without leave)?
They may be apprehended and returned to the hospital at any time
What happens when a In-Patient subject to a CTO (Compulsory Treatment Order) goes AWOL (absconds/absent without leave)?
If they are apprehended within three months of going missing, they are returned to the hospital.
If they are absent for over/more than three months, they are deemed to be released from their CTO and a new application for assessement must be completed.
