Question 1

[5] ἡμεῖς γὰρ ἐπεθυμήσαμεν, ὦ βουλή, Θεοδότου, Πλαταϊκοῦ μειρακίου, καὶ ἐγὼ μὲν εὖ ποιῶν αὐτὸν ἠξίουν εἶναί μοι φίλον,

We set our hearts, gentlemen of the jury, upon Theodotus, a Plataean lad; and while I by treating him well deigned to make him my boyfriend,

οὗτος δὲ ὑβρίζων καὶ παρανομῶν ᾤετο ἀναγκάσειν αὐτὸν ποιεῖν ὅ τι βούλοιτο.

this man thought by abuse and criminality to compel him to accede to his wishes.

ὅσα μὲν οὖν ἐκεῖνος κακὰ ὑπ᾽ αὐτοῦ πέπονθε, πολὺ ἂν ἔργον εἴη λέγειν:

To tell all the ill-treatment that [the boy] has suffered at his hands would be a lengthy business:

ὅσα δὲ εἰς ἐμὲ αὐτὸν ἐξημάρτηκεν, [6] ἡγοῦμαι ταῦθ᾽ ὑμῖν προσήκειν ἀκοῦσαι.

but as regards the offences he has committed against myself, I think it proper that you should hear

πυθόμενος γὰρ ὅτι τὸ μειράκιον ἦν παρ᾽ ἐμοί, ἐλθὼν ἐπὶ τὴν οἰκίαν τὴν ἐμὴν νύκτωρ μεθύων,

For upon learning that the boy was chez moi, coming against my house by night, drunk,

ἐκκόψας τὰς θύρας εἰσῆλθεν εἰς τὴν γυναικωνῖτιν, ἔνδον οὐσῶν τῆς τε ἀδελφῆς τῆς ἐμῆς καὶ τῶν ἀδελφιδῶν,

he broke down the doors and entered into the women’s quarters, wherein were both my sister and nieces

αἳ οὕτω κοσμίως βεβιώκασιν ὥστε καὶ ὑπὸ τῶν οἰκείων ὁρώμεναι αἰσχύνεσθαι.

who have led such well-behaved lives that they are ashamed (even) to be seen by the men of the household.

οὗτος τοίνυν εἰς τοῦτο ἦλθεν ὕβρεως ὥστ᾽ οὐ πρότερον ἠθέλησεν ἀπελθεῖν,

Thus the man carried his insolence to such a pitch that he would not leave

πρὶν αὐτὸν ἡγούμενοι δεινὰ ποιεῖν οἱ παραγενόμενοι καὶ οἱ μετ᾽ αὐτοῦ ἐλθόντες, ἐπὶ παῖδας κόρας καὶ ὀρφανὰς εἰσιόντα, ἐξήλασαν βίᾳ.

until those present and those who had come with him, thinking that he was behaving terribly, invading in upon young girls -orphans at that- drove him out by force.

καὶ τοσούτου ἐδέησεν αὐτῷ μεταμελῆσαι τῶν ὑβρισμένων, ὥστε ἐξευρὼν οὗ ἐδειπνοῦμεν ἀτοπώτατον πρᾶγμα καὶ ἀπιστότατον ἐποίησεν, εἰ μή τις εἰδείη τὴν τούτου μανίαν.

Answer 10

And this man was so far from relenting from his outrages that, finding out where we were dining, he behaved in a most irregular and unbelievable manner, except to one familiar with his insanity.

[8] ἐκκαλέσας γάρ με ἔνδοθεν, ἐπειδὴ τάχιστα ἐξῆλθον, εὐθύς με τύπτειν ἐπεχείρησεν:

For calling me out from within, he attempted to strike me as soon as I came out

ἐπειδὴ δὲ αὐτὸν ἠμυνάμην, ἐκστὰς ἔβαλλέ με λίθοις.

when I fended him off, he stood at a distance and pelted me with stones.

καὶ ἐμοῦ μὲν ἁμαρτάνει, Ἀριστοκρίτου δέ, ὃς παρ᾽ ἐμὲ ἦλθε μετ᾽ αὐτοῦ, βαλὼν λίθῳ συντρίβει τὸ μέτωπον.

But he missed me and instead hit Aristocritus, who had come against me with him, and by hurling a stone broke his forehead.

ἐγὼ τοίνυν, ὦ βουλή, ἡγούμενος μὲν δεινὰ πάσχειν, αἰσχυνόμενος δέ, ὅπερ ἤδη καὶ πρότερον εἶπον, τῇ συμφορᾷ, ἠνειχόμην,

So I, gentlemen, feeling myself grossly ill-used, but ashamed—as I have already told you before—at my misfortune, put up with it

καὶ μᾶλλον ᾑρούμην μὴ λαβεῖν τούτων τῶν ἁμαρτημάτων δίκην ἢ δόξαι τοῖς πολίταις ἀνόητος εἶναι,

and rather preferred not to bring these offences to justice than give the impression to my fellow citizens of being a fool:

εἰδὼς ὅτι τῇ μὲν τούτου πονηρίᾳ πρέποντα ἔσται τὰ πεπραγμένα,

for although I knew that these actions befitted the man’s wicked character,

ἐμοῦ δὲ πολλοὶ καταγελάσονται τοιαῦτα πάσχοντος τῶν φθονεῖν εἰθισμένων, ἐάν τις ἐν τῇ πόλει προθυμῆται χρηστὸς εἶναι.

I also knew that many people would laugh at me for going through all this, from among those who were in the habit of holding grudges against anyone who desired to be a good citizen.

[10] οὕτω δὲ σφόδρα ἠπορούμην ὅ τι χρησαίμην, ὦ βουλή, τῇ τούτου παρανομίᾳ, ὥστε ἔδοξέ μοι κράτιστον εἶναι ἀποδημῆσαι ἐκ τῆς πόλεως.

Answer 18

Thus was I so at a loss at what I have described so far, gentlemen of the jury, of this man’s lawless behaviour, that I seemed best for me to emigrate from the city.

λαβὼν δὴ τὸ μειράκιον（ἅπαντα γὰρ δεῖ τἀληθῆ λέγειν） ᾠχόμην ἐκ τῆς πόλεως.

So taking the boy along (for I must disclose the whole truth) I left the city

ἐπειδὴ δὲ ᾤμην ἱκανὸν εἶναι τὸν χρόνον Σίμωνι ἐπιλαθέσθαι μὲν τοῦ νεανίσκου, μεταμελῆσαι δὲ τῶν πρότερον ἡμαρτημένων,

But when I judged the elapsed time to be sufficient for Simon to have forgotten the boy, and have relented from his prior misbehaviour,

[11] ἀφικνοῦμαι πάλιν. κἀγὼ μὲν ᾠχόμην εἰς Πειραιᾶ, οὗτος δ᾽ αἰσθόμενος εὐθέως ἥκοντα τὸν Θεόδοτον καὶ διατρίβοντα παρὰ Λυσιμάχῳ,

I came home. And I came back through the Peiraios, but the plaintiff, immediately catching wind that Theodotus had arrived and was lodging with Lysimachos,

ὃς ᾤκει πλησίον τῆς οἰκίας ἧς οὗτος ἐμεμίσθωτο, παρεκάλεσέ τινας τῶν τούτου ἐπιτηδείων.

who lived neighbouring the house that the prosecution was renting, invited some of his companions to dinner.

καὶ οὗτοι μὲν ἠρίστων καὶ ἔπινον, φύλακας δὲ κατέστησαν ἐπὶ τοῦ τέγους, ἵν᾽, ὁπότε ἐξέλθοι τὸ μειράκιον,

and these, lunching and drinking, placed guards on the roof in order that as soon as the boy came out

[12] εἰσαρπάσειαν αὐτόν. ἐν δὲ τούτῳ τῷ καιρῷ ἀφικνοῦμαι ἐγὼ ἐκ Πειραιῶς, καὶ τρέπομαι παριὼν ὡς τὸν Λυσίμαχον:

they might seize him. At this precise time I arrived from Peiraios, and I stopped off at Lysimachos’ house:

and after staying there a short while we went out.

οὗτοι δ᾽ ἤδη μεθύοντες1 ἐκπηδῶσιν ἐφ᾽ ἡμᾶς καὶ οἱ μέν τινες αὐτῷ τῶν παραγενομένων οὐκ ἠθέλησαν συνεξαμαρτεῖν,

But by then these men, already drunk, fell upon us, and whilst some of those present were not willing to be party to the crime,

Σίμων δὲ οὑτοσὶ καὶ Θεόφιλος καὶ Πρώταρχος καὶ Αὐτοκλῆς εἷλκον τὸ μειράκιον. ὁ δὲ ῥίψας τὸ ἱμάτιον ᾤχετο φεύγων.

Simon here, and Theophilos, Protarchos and Autocles dragged the lad along. But he discarded his cloak and made off in flight.

[13] ἐγὼ δὲ ἡγούμενος ἐκεῖνον μὲν ἐκφεύξεσθαι, τούτους δ᾽, ἐπειδὴ τάχιστα ἐντύχοιεν ἀνθρώποις, αἰσχυνομένους ἀποτρέψεσθαι —

And I -thinking he would escape, whilst they would immediately turn in shame as soon as they encountered anyone-

ταῦτα διανοηθεὶς ἑτέραν ὁδὸν ᾠχόμην ἀπιών: οὕτω σφόδρ᾽ αὐτοὺς ἐφυλαττόμην, καὶ πάντα τὰ ὑπὸ τούτων γιγνόμενα μεγάλην ἐμαυτῷ συμφορὰν ἐνόμιζον.

knowing this, I made my escape via another street: I was so wary of them them, and considered all their actions to be a grievous misfortune against me.

[14] κἀνταῦθα μέν, ἵνα φησὶ Σίμων τὴν μάχην γενέσθαι, οὔτε τούτων οὔτε ἡμῶν οὐδεὶς οὔτε κατεάγη τὴν κεφαλὴν οὔτε ἄλλο κακὸν οὐδὲν ἔλαβεν, ὧν ἐγὼ τοὺς παραγενομένους ὑμῖν παρέξομαι μάρτυρας.

And so, in the location where Simon says the fight took place, no one of either his party or ours either broke his head nor suffered any other harm, for which I bring forth as witnesses those who were present:

ὅτι μὲν τοίνυν οὗτος ἦν ὁ ἀδικήσας, ὦ βουλή, καὶ ἐπιβουλεύσας ἡμῖν, καὶ οὐκ ἐγὼ τούτῳ, ὑπὸ τῶν παραγενομένων μεμαρτύρηται ὑμῖν.

That then this man was the wrongdoer, gentlemen, and that he had schemed against us, and not I upon him, has been testified to you by those who were present.

μετὰ δὲ ταῦτα τὸ μὲν μειράκιον εἰς γναφεῖον κατέφυγεν, οὗτοι δὲ συνεισπεσόντες ἦγον αὐτὸν βίᾳ, βοῶντα καὶ κεκραγότα καὶ μαρτυρόμενον.

Hereafter the lad fled into a fuller’s shop, but Simon’s gang falling upon him, brought him out by force, shouting and crying for help and calling bystanders to witness.

[16] συνδραμόντων δὲ ἀνθρώπων πολλῶν καὶ ἀγανακτούντων τῷ πράγματι καὶ δεινὰ φασκόντων εἶναι τὰ γιγνόμενα:

[16] And when a crowd of many people came running and protesting the deed and denouncing their actions as evil,

τῶν μὲν λεγομένων οὐδὲν ἐφρόντιζον, Μόλωνα δὲ τὸν γναφέα καὶ ἄλλους τινὰς ἐπαμύνειν ἐπιχειροῦντας συνέκοψαν.

the gang did not concern themselves with what was said, instead beating up Molon the fuller and a few others who were attempting to intervene.

[17] ἤδη δὲ αὐτοῖς οὖσι παρὰ τὴν Λάμπωνος οἰκίαν ἐγὼ μόνος βαδίζων ἐντυγχάνω,

[17] They had already got as far as Lampon’s when I, walking by myself, met with them;

δεινὸν δὲ ἡγησάμενος εἶναι καὶ αἰσχρὸν περιιδεῖν οὕτως ἀνόμως καὶ βιαίως ὑβρισθέντα τὸν νεανίσκον, ἐπιλαμβάνομαι αὐτοῦ.

and considering it a monstrous and shameful thing to stand by and see the youth so lawlessly and violently abused, I seized him for myself.

οὗτοι δέ, διότι μὲν τοιαῦτα παρενόμουν εἰς ἐκεῖνον, οὐκ ἠθέλησαν εἰπεῖν ἐρωτηθέντες,

They, when asked why they were treating him in such lawless fashion, refused to answer,

ἀφέμενοι δὲ τοῦ νεανίσκου ἔτυπτον ἐμέ. μάχης δὲ γενομένης,

but letting the young man go they began to beat me. And a fight ensued,

[18] ὦ βουλή, καὶ τοῦ μειρακίου βάλλοντος αὐτοὺς καὶ περὶ τοῦ σώματος ἀμυνομένου καὶ τούτων ἡμᾶς βαλλόντων,

[18] gentlemen; with the boy pelting them and defending his person, while they were pelting us;

ἔτι δὲ τυπτόντων αὐτὸν ὑπὸ τῆς μέθης καὶ ἐμοῦ ἀμυνομένου,

they also, in their drunkenness, were beating him and I was defending myself,

Question 41

καὶ τῶν παραγενομένων ὡς ἀδικουμένοις ἡμῖν ἁπάντων ἐπικουρούντων

and the others present were all supporting us, as being the injured party;

ἐν τούτῳ τῷ θορύβῳ συντριβόμεθα τὰς κεφαλὰς ἅπαντες.

and in this brawl we all of us got our heads broken.

[19] καὶ οἱ μὲν ἄλλοι οἱ μετὰ τούτου παροινήσαντες, ἐπειδὴ τάχιστά με εἶδον μετὰ ταῦτα, ἐδέοντό μου συγγνώμην ἔχειν,

[19] And the others whom Simon had led into this drunken assault, at their first sight of me after these proceedings begged my pardon,

οὐχ ὡς ἀδικούμενοι ἀλλ᾽ ὡς δεινὰ πεποιηκότες:

not as wronged men but as ones who had behaved terribly;

καὶ ἐξ ἐκείνου τοῦ χρόνου τεττάρων ἐτῶν παρεληλυθότων οὐδέν μοι πώποτε ἐνεκάλεσεν οὐδείς.

and though since that time four years have elapsed, nobody has ever brought any charge against me.

[20] Σίμων δ᾽ οὑτοσί, πάντων τῶν κακῶν αἴτιος γενόμενος, τὸν μὲν ἄλλον χρόνον ἡσυχίαν ἦγε δεδιὼς περὶ αὑτοῦ,

[20] But Simon here, despite being responsible for all these evils, kept quiet for some time, in fear for himself;

ἐπειδὴ δὲ δίκας ἰδίας ᾔσθετο κακῶς ἀγωνισάμενον ἐξ ἀντιδόσεως,

but when he became aware that I had litigated badly in private cases regarding an exchange of property,

καταφρονήσας μου οὑτωσὶ τολμηρῶς εἰς τοιοῦτον ἀγῶνά με κατέστησεν.

he conceived a contempt for me and, with the audacity that you now see, has involved me in this serious prosecution.

ὡς οὖν καὶ ταῦτ᾽ ἀληθῆ λέγω, τούτων ὑμῖν τοὺς παραγενομένους μάρτυρας παρέξομαι.

That regarding these things too I am speaking the truth, I will provide for you as witnesses those present at these events.

τὰ μὲν οὖν γεγενημένα καὶ ἐμοῦ καὶ τῶν μαρτύρων ἀκηκόατε:

So you have heard what has taken place both from myself and the witnesses;

ἐβουλόμην δ᾽ ἄν, ὦ βουλή, Σίμωνα τὴν αὐτὴν γνώμην ἐμοὶ ἔχειν,

and I was hoping, gentlemen, that Simon might have the same intentions as I,

ἵν᾽ ἀμφοτέρων ἡμῶν ἀκούσαντες τἀληθῆ ῥᾳδίως ἔγνωτε τὰ δίκαια.

so that having heard the truth from us both you might easily know the just verdict.

ἐπειδὴ δὲ αὐτῷ οὐδὲν μέλει τῶν ὅρκων ὧν ὠμόσατο, πειράσομαι καὶ περὶ ὧν οὗτος ἔψευσται διδάσκειν ὑμᾶς.

But since he cares nothing for the oaths that he has sworn, I will try also to inform you concerning the lies that he has told.

[22] ἐτόλμησε γὰρ εἰπεῖν ὡς αὐτὸς μὲν τριακοσίας δραχμὰς ἔδωκε Θεοδότῳ,

[22] He dared to state that on his part he had given three hundred drachmae to Theodotus,

συνθήκας πρὸς αὐτὸν ποιησάμενος, ἐγὼ δ᾽ ἐπιβουλεύσας ἀπέστησα αὐτοῦ τὸ μειράκιον.

having made a deal with him, and that I by scheming led the boy away from him.

καίτοι ἐχρῆν αὐτόν, εἴπερ ἦν ταῦτ᾽ ἀληθῆ, παρακαλέσαντα μάρτυρας ὡς πλείστους κατὰ τοὺς νόμους διαπράττεσθαι περὶ αὐτῶν.

And yet it behooved him, if indeed this was the truth, to summon as many witnesses as he could according to our laws and and to conduct this affair in compliance with them.

[23] οὗτος δὲ τοιοῦτον οὐδὲν πώποτε φαίνεται ποιήσας,

[23] But the man does not appear to have ever done any such thing,

ὑβρίζων δὲ καὶ τύπτων ἅμ᾽ἀμφοτέρους ἡμᾶς καὶ κωμάζων καὶ τὰς θύρας ἐκβάλλων καὶ νύκτωρ εἰσιὼν ἐπὶ γυναῖκας ἐλευθέρας.

instead transgressing against and beating us both, and has behaved like a lout, and broken-and-entered and invaded in on free women by night.

ἃ χρὴ μάλιστα, ὦ βουλή, τεκμήρια νομίζειν ὅτι ψεύδεται πρὸς ὑμᾶς.

All of which, gentlemen, you should most assuredly judge to be proof that he is lying to you.

Question 60

[24] σκέψασθε δὲ ὡς ἄπιστα εἴρηκε. τὴν γὰρ οὐσίαν τὴν ἑαυτοῦ ἅπασαν πεντήκοντα καὶ διακοσίων δραχμῶν ἐτιμήσατο.

And then, consider how incredible his statements are. He has valued his net-worth altogether at two hundred and fifty drachmae:

καίτοι θαυμαστὸν εἰ τὸν ἑταιρήσοντα πλειόνων ἐμισθώσατο ὧν αὐτὸς τυγχάνει κεκτημένος.

yet how bizzare that he should hire his companion for more than he himself happens to own!

[25] εἰς τοῦτο δ᾽ ἥκει τόλμης ὥστε οὐκ ἐξαρκεῖ περὶ τούτου μόνον αὐτῷ ψεύσασθαι, περὶ τοῦ δεδωκέναι τὸ ἀργύριον, ἀλλὰ καὶ κεκομίσθαι φησί:

[25] And he has reached such a pitch of daring that it is not enough for merely to lie about the giving over of the money, but he even says that he has recovered it!

καίτοι πῶς εἰκός ἐστι τότε μὲν ἡμᾶς τοιαῦτα ἐξαμαρτάνειν οἷα κατηγόρηκεν οὗτος, ἀποστερῆσαι βουλομένους τὰς τριακοσίας δραχμάς,

Yet how plausible is it then that we sinned thus, as he has alleged, namely that I wanted deprive him of three hundred drachmae—

ἐπειδὴ δὲ ἀπεμαχεσάμεθα, τηνικαῦτα ἀποδοῦναι τὸ ἀργύριον αὐτῷ, μήτε ἀφειμένους τῶν ἐγκλημάτων μήτε ἀνάγκης ἡμῖν μηδεμιᾶς γενομένης;

and that once we won the fight, I at that time repaid him the money, without either being cleared of the charges or being subjected to any compulsion?

[26] ἀλλὰ γάρ, ὦ βουλή, πάντα αὐτῷ ταῦτα σύγκειται καὶ μεμηχάνηται, καὶ δοῦναι μέν φησιν, ἵνα μὴ δοκῇ δεινὰ ποιεῖν, εἰ μηδενὸς αὐτῷ συμβολαίου γεγενημένου τοιαῦτα ἐτόλμα ὑβρίζειν τὸ μειράκιον,

[26] Why, gentlemen, this is all mere invention and artifice of his: he says that he gave it, so as to avoid the scandal of daring to commit such an outrage on the lad without any bargain struck between them;

ἀπειληφέναι δὲ προσποιεῖται, διότι φανερός ἐστιν ἐγκαλέσας οὐδέποτ᾽ ἀργύριον οὐδὲ μνείαν περὶ τούτου οὐδεμίαν ποιησάμενος.

and he pretends that he has got it back, because it is clear that he never laid a claim to money or made the least mention of the matter.

φησὶ δ᾽ ἐπὶ ταῖς αὑτοῦ θύραις ὑπ᾽ ἐμοῦ δεινῶς διατεθῆναι τυπτόμενος.

He says that I gave him a beating at the door of his house, which left him in a terrible state.

φαίνεται δὲ πλεῖν ἢ τέτταρα στάδια ἀπὸ τῆς οἰκίας διώξας τὸ μειράκιον οὐδὲν κακὸν ἔχων, καὶ ταῦτα πλεῖν ἢ διακοσίων ἰδόντων ἀνθρώπων ἔξαρνός ἐστι.

Answer 68

But we find that he pursued the boy for more than four stades1 from his house with no sign of injury, and I this he denies, although it was seen by more than two hundred people.

λέγει δ᾽ ὡς ἡμεῖς ἤλθομεν ἐπὶ τὴν οἰκίαν τὴν τούτου ὄστρακον ἔχοντες, καὶ ὡς ἠπείλουν αὐτῷ ἐγὼ ἀποκτενεῖν, καὶ ὡς τοῦτό ἐστιν ἡ πρόνοια.

He states that we went to his house with potsherds in our hands, and that I threatened to kill him, and that this is premeditation.

ἐγὼ δ᾽ ἡγοῦμαι, ὦ βουλή, ῥᾴδιον εἶναι γνῶναι ὅτι ψεύδεται, οὐ μόνον ὑμῖν τοῖς εἰωθόσι σκοπεῖσθαι περὶ τῶν τοιούτων, ἀλλὰ καὶ τοῖς ἄλλοις ἅπασι.

But I think that this lie of his, gentlemen, is easily detected, not only by you who are used to investigating this sort of case, but by everyone else as well.
