Strengthening one’s bond with Allah | مراعاة قيمة العبودية لله تعالى

A

وَمَا خَلَقْتُ الْجِنَّ وَالْاِنْسَ اِلَّا لِيَعْبُدُوْنِ

And I did not create the jinn and mankind except to worship Me.

One can’t enter paradise without worshipping Allah alone, this is why the first chapter in Fiqh is al ibadat-matters pertaining to worship of Allah. To strengthen the bond between the created and the creator.

It buillds the inner of you, as such the messenger SallAllahu alayhiwasalam nurtured his sahaba upon this.

يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ كُتِبَ عَلَيْكُمُ ٱلصِّيَامُ كَمَا كُتِبَ عَلَى ٱلَّذِينَ مِن قَبْلِكُمْ لَعَلَّكُمْ تَتَّقُونَ

O you who have believed, decreed upon you is fasting as it was decreed upon those before you that you may become righteous -

From ibadah a person attains taqwa. There was a sahabi who did zina, and he came to the messenger SallAllahu alayhiwasalam due to this taqwa.

Man made systems require police, and so on in order to enforce, it isn’t something the people innately believe in

Easing affairs and removing hardship | السماحة ورفع الحرج

A

*يُرِيْدُ اللّٰهُ بِكُمُ الْيُسْرَ وَلَا يُرِيْدُ بِكُمُ الْعُسْرَ
Allāh intends for you ease and does not intend for you hardship

حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، قَالَتْ مَا خُيِّرَ رَسُولُ اللَّهِ صلى الله عليه وسلم بَيْنَ أَمْرَيْنِ أَحَدُهُمَا أَيْسَرُ مِنَ الآخَرِ إِلاَّ اخْتَارَ أَيْسَرَهُمَا مَا لَمْ يَكُنْ إِثْمًا فَإِنْ كَانَ إِثْمًا كَانَ أَبْعَدَ النَّاسِ مِنْهُ ‏.‏
‘A’isha reported:
Never did Allah’s Messenger (ﷺ) make a choice between two things but adopting the easier one as compared to the difficult one, but his choice for the easier one was only in case it did not involve any sin, but if it involved sin he was the one who was the farthest from it amongst the people.

By replacing it with something easier, while keeping in mind the original ruling

> عَنْ عِمْرَانَ بْنِ حُصَيْنٍ ـ رضى الله عنه ـ قَالَ كَانَتْ بِي بَوَاسِيرُ فَسَأَلْتُ النَّبِيَّ صلى الله عليه وسلم عَنِ الصَّلاَةِ فَقَالَ ‏
“‏ صَلِّ قَائِمًا، فَإِنْ لَمْ تَسْتَطِعْ فَقَاعِدًا، فَإِنْ لَمْ تَسْتَطِعْ فَعَلَى جَنْبٍ ‏”
‏‏.‏

Narrated `Imran bin Husain:

*I had piles, so I asked the Prophet (ﷺ) about the prayer. He said, “Pray while standing and if you can’t, pray while sitting and if you cannot do even that, then pray Lying on your side.”

> عن أبي موسى الأشعري رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم:

«إِذَا مَرِضَ الْعَبْدُ أَوْ سَافَرَ كُتِبَ لَهُ مِثْلُ مَا كَانَ يَعْمَلُ مُقِيمًا صَحِيحًا».

Abu Mūsa al-Ash‘ari (may Allah be pleased with him) reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) said:”If a person falls ill or travels, he shall be credited with whatever good deeds he used to perform while being at home and in good health.”

The gradual coming of legislation | التدرج في التشريع

A

It came down part by part, looking in the situation of the people, when an issue occurs, an answer was brought.

Something that happens/is done over time, tends to last longer than

what happens/done fast

عَنِ ابْنِ عَبَّاسٍ ـ رضى الله عنهما ـ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِمُعَاذِ بْنِ جَبَلٍ حِينَ بَعَثَهُ إِلَى الْيَمَنِ ‏
**
“‏ إِنَّكَ سَتَأْتِي قَوْمًا مِنْ أَهْلِ الْكِتَابِ، فَإِذَا جِئْتَهُمْ فَادْعُهُمْ إِلَى أَنْ يَشْهَدُوا أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ، وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ، فَإِنْ هُمْ طَاعُوا لَكَ بِذَلِكَ فَأَخْبِرْهُمْ أَنَّ اللَّهَ قَدْ فَرَضَ عَلَيْهِمْ خَمْسَ صَلَوَاتٍ فِي كُلِّ يَوْمٍ وَلَيْلَةٍ، فَإِنْ هُمْ طَاعُوا لَكَ بِذَلِكَ، فَأَخْبِرْهُمْ أَنَّ اللَّهَ قَدْ فَرَضَ عَلَيْكُمْ صَدَقَةً، تُؤْخَذُ مِنْ أَغْنِيَائِهِمْ، فَتُرَدُّ عَلَى فُقَرَائِهِمْ، فَإِنْ هُمْ طَاعُوا لَكَ بِذَلِكَ، فَإِيَّاكَ وَكَرَائِمَ أَمْوَالِهِمْ، وَاتَّقِ دَعْوَةَ الْمَظْلُومِ فَإِنَّهُ لَيْسَ بَيْنَهُ وَبَيْنَ اللَّهِ حِجَابٌ ‏
**

Narrated Ibn `Abbas:

*Allah’s Messenger (ﷺ) said to Muadh bin Jabal when he sent him to Yemen. "You will come to the people of Scripture, and when you reach them, invite them to testify that none has the right to be worshipped except Allah and that Muhammad is His Apostle. And if they obey you in that, then tell them that Allah has enjoined on them five prayers to be performed every day and night. And if they obey you in that, then tell them that Allah has enjoined on them Sadaqa (i.e. rakat) to be taken from the rich amongst them and given to the poor amongst them. And if they obey you in that, then be cautious! Don’t take their best properties (as Zakat) and be afraid of the curse of an oppressed person as there is no screen between his invocation and Allah.

> يُوسُفُ بْنُ مَاهَكَ، قَالَ إِنِّي عِنْدَ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ ـ رضى الله عنها ـ إِذْ جَاءَهَا عِرَاقِيٌّ فَقَالَ أَىُّ الْكَفَنِ خَيْرٌ قَالَتْ وَيْحَكَ وَمَا يَضُرُّكَ قَالَ يَا أُمَّ الْمُؤْمِنِينَ أَرِينِي مُصْحَفَكِ‏.‏ قَالَتْ لِمَ قَالَ لَعَلِّي أُوَلِّفُ الْقُرْآنَ عَلَيْهِ فَإِنَّهُ يُقْرَأُ غَيْرَ مُؤَلَّفٍ‏.‏ قَالَتْ وَمَا يَضُرُّكَ أَيَّهُ قَرَأْتَ قَبْلُ، إِنَّمَا نَزَلَ أَوَّلَ مَا نَزَلَ مِنْهُ سُورَةٌ مِنَ الْمُفَصَّلِ فِيهَا ذِكْرُ الْجَنَّةِ وَالنَّارِ حَتَّى إِذَا ثَابَ النَّاسُ إِلَى الإِسْلاَمِ نَزَلَ الْحَلاَلُ وَالْحَرَامُ، وَلَوْ نَزَلَ أَوَّلَ شَىْءٍ لاَ تَشْرَبُوا الْخَمْرَ‏.‏ لَقَالُوا لاَ نَدَعُ الْخَمْرَ أَبَدًا‏.‏ وَلَوْ نَزَلَ‏.‏ لاَ تَزْنُوا‏.‏ لَقَالُوا لاَ نَدَعُ الزِّنَا أَبَدًا‏.‏ لَقَدْ نَزَلَ بِمَكَّةَ عَلَى مُحَمَّدٍ صلى الله عليه وسلم وَإِنِّي لَجَارِيَةٌ أَلْعَبُ ‏
{‏بَلِ السَّاعَةُ مَوْعِدُهُمْ وَالسَّاعَةُ أَدْهَى وَأَمَرُّ‏}
‏ وَمَا نَزَلَتْ سُورَةُ الْبَقَرَةِ وَالنِّسَاءِ إِلاَّ وَأَنَا عِنْدَهُ‏.‏ قَالَ فَأَخْرَجَتْ لَهُ الْمُصْحَفَ فَأَمْلَتْ عَلَيْهِ آىَ السُّوَرِ‏
**

Narrated Yusuf bin Mahk:

While I was with Aisha, the mother of the Believers, a person from Iraq came and asked, “What type of shroud is the best?” Aisha said, "May Allah be merciful to you! What does it matter?" He said, "O mother of the Believers! Show me (the copy of) your Qur'an," She said, "Why?" He said, "In order to compile and arrange the Qur'an according to it, for people recite it with its Suras not in proper order." Aisha said, “What does it matter which part of it you read first? (Be informed) that the first thing that was revealed thereof was a Sura from Al-Mufassal, and in it was mentioned Paradise and the Fire. When the people embraced Islam, the Verses regarding legal and illegal things were revealed. If the first thing to be revealed was: ‘Do not drink alcoholic drinks.’ people would have said, ‘We will never leave alcoholic drinks,’ and if there had been revealed, ‘Do not commit illegal sexual intercourse, ‘they would have said, ‘We will never give up illegal sexual intercourse.’ While I was a young girl of playing age, the following Verse was revealed in Mecca to Muhammad: ‘Nay! But the Hour is their appointed time (for their full recompense), and the Hour will be more grievous and more bitter.’ (54.46) Sura Al-Baqara (The Cow) and Surat An-Nisa (The Women) were revealed while I was with him.” Then `Aisha took out the copy of the Qur’an for the man and dictated to him the Verses of the Suras (in their proper order).

Statement of the salaf and poetry regarding persistence

  • عَنْ يُونُسَ قَالَ: قَالَ لِي ابْنُ شِهَابٍ: «يَا يُونُسُ! لاَ تُكَابِرِ ِالعِلْمَ، فَإِنَّ العِلْمَ أَوْدِيَةٌ فَأَيَّهَا أََخَذْتَ فِيهِ قَطَعَ بِكَ قَبْلَ أَنْ تَبْلُغَهُ، وَلَكِنْ خُذْهُ مَعَ الأَيَّامِ وَاللَّيَالِي، وَلاَ تَأْخُذِ العِلْمَ جُمْلَةًً، فَإِنَّ مَنْ رَامَ أَخْذَهُ جُمْلَةً ذَهَبَ عَنْهُ جُمْلَةً، وَلَكِنِ الشَّيْءَ بعْدَ الشَّيْءِ مَعَ اللَّيَالِي وَالأَيَّامِ» [«جامع بيان العلم وفضله» لابن عبد البرّ: (431)].
    It is reported that Al-Zuhrī – Allāh have mercy on him – said to Yūnus b. Yazīd: > O Yūnus! Do not try to overcome knowledge, for verily knowledge is [like vast] valleys: whichever of them you take will stop you before you traverse it. Instead, take it over the days and nights. And do not take knowledge all at once, for whoever tries to take it all at once will lose it all at once. Rather take it bit by bit over the days and nights.
    • Ibn ʿAbd Al-Barr, Jāmiʿ Bayān Al-ʿIlm

** من رامَ العلم جملة ، ذهب عنه جملة
**
Whoever seeks knowledge all at once, it will leave him all at once.*

The poet said:

** > اُطلُبْ وَلَا تَضْجَرَ مِنْ مَطلَبٍ * فآفَةُ الطَّالِبِ أنْ يَضْجَرَا
**

** أَمَا تَرَى الحبلَ بتكرَارِه * في الصَّخْرَة الصَّمَّاءِ قَدْ أثّرا
**
* Seek and do not tire of seeking, for the bane of the seeker is to become weary. Do you not see how the rope, through repeated strikes, leaves a mark on the solid rock?
*

Another version of the line of poetry:

** اُطْلُبْ وَلَاتَضْجَرْمِنمَطْلَبٍ
**
** فَآفَةُالطَّالِبِأَنْيَضْجَرَا
**
** أَمَاتَرَىالْمَاءَبِتِكْرَارِهِ
**
** فِيالصَّخْرَةِالصَّمَّاءِقَدْأَثَّرَا؟
**

  • “Seekanddonottireofseeking,forthebaneoftheseekeristobecomeweary.Doyounotseehowwater,throughrepeatedstrikes,leavesamarkonthesolidrock?”*

Focusing on the important issues that people are in need of | المرونة

  • يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ لَا تَسْـَٔلُوا۟ عَنْ أَشْيَآءَ إِن تُبْدَ لَكُمْ تَسُؤْكُمْ وَإِن تَسْـَٔلُوا۟ عَنْهَا حِينَ يُنَزَّلُ ٱلْقُرْءَانُ تُبْدَ لَكُمْ عَفَا ٱللَّهُ عَنْهَا ۗ وَٱللَّهُ غَفُورٌ حَلِيمٌۭO you who have believed, do not ask about things which, if they are shown to you, will distress you. But if you ask about them while the Qur’ān is being revealed, they will be shown to you. Allāh has pardoned it [i.e., that which is past]; and Allāh is Forgiving and Forbearing.

Certain things the answers weren’t given to you as a mercy. Don’t ask if your father is in paradise or hell, it may the case you might find out about something that hurts you. The Shariah turned away from unimportant things, and focused on things that were important.

  • عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏
  • ** “‏ إِنَّ أَعْظَمَ الْمُسْلِمِينَ جُرْمًا مَنْ سَأَلَ عَنْ شَىْءٍ لَمْ يُحَرَّمْ، فَحُرِّمَ مِنْ أَجْلِ مَسْأَلَتِهِ ‏”
    **
    Narrated Sa`d bin Abi Waqqas:
    The Prophet (ﷺ) said, “The most sinful person among the Muslims is the one who asked about something which had not been prohibited, but was prohibited because of his asking.”This is because the Shariah was already answering things that people needed to know.

Observing the people’s benefits | رعاية مصالح الناس

** الضروريات الخمس-5 necessities to be observed which are the objectives of the Shariah
**
** 1. Religion(الدين)
** 2. Life(النفس)
** 3. Intellect(العقل)
** 4. Lineage/honor (العرض)

5. Property(المال)
**

In the beginning of Islam, visiting the graves was prohibited, as they had just came from shirk, and when they’re entrenchment in shirk was lifted, the reason for the prohibition was no longer there. 

**عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏:‏ ‏ “‏ نَهَيْتُكُمْ عَنْ زِيَارَةِ الْقُبُورِ فَزُورُوهَا
**
**وفي رواية ‏”‏فمن أراد أن يزور القبور فليزر؛ فإنها تذكرنا الآخرة ‏”‏
**

**Buraidah (May Allah be pleased with him) reported:**
  • the Messenger of Allah (ﷺ) said, “(In the past) I forbade you from visiting graves, but visit them now.”

  • In another narration Messenger of Allah (ﷺ) said, “Whoever wants to visit a graveyard, let him do so, because it reminds us of the Hereafter.”
    *
    وَقَالُوا۟ لَا تَذَرُنَّ ءَالِهَتَكُمْ وَلَا تَذَرُنَّ وَدًّۭا وَلَا سُوَاعًۭا وَلَا يَغُوثَ وَيَعُوقَ وَنَسْرًۭاAnd said, ‘Never leave your gods and never leave Wadd or Suwāʿ or Yaghūth and Yaʿūq and Nasr.’-These were the names of specific idols named after pious men of earlier generations.So, Islam came and stopped them from going to the graves. When they’re ‘Aqeedah became correct it permitted again.

How do manmade laws and constitutions not observe the peoples benefits?

A

Constitutions/man made laws don’t do this, the people who are in charge are looking out for their parties sake, their own wealth and what furthers their interests, those who fund them the lobbyists etc., The people are the last people they care about. When the French revolution happened, they got rid of the churches in what they called the enlightenment, as the churches were preventing them from progression, and religion was seen as something bad, rightly so to an extent as how the popes and priests were doing, so they thought religion was like this.

Allah commands justice | تحقيق العدل بين الناس

A

۞ إِنَّ ٱللَّهَ يَأْمُرُ بِٱلْعَدْلِ وَٱلْإِحْسَـٰنِ وَإِيتَآئِ ذِى ٱلْقُرْبَىٰ وَيَنْهَىٰ عَنِ ٱلْفَحْشَآءِ وَٱلْمُنكَرِ وَٱلْبَغْىِ ۚ يَعِظُكُمْ لَعَلَّكُمْ تَذَكَّرُونَ

Indeed, Allāh orders justice and good conduct and giving [help] to relatives and forbids immorality and bad conduct and oppression. He admonishes you that perhaps you will be reminded.

This religion isn’t one that favors one individual/group over another. For this reason, the following hadiths (they’re different narrations) are important:

عَنْ عَائِشَةَ، قَالَتْ سَرَقَتِ امْرَأَةٌ مِنْ قُرَيْشٍ مِنْ بَنِي مَخْزُومٍ فَأُتِيَ بِهَا النَّبِيُّ صلى الله عليه وسلم فَقَالُوا مَنْ يُكَلِّمُهُ فِيهَا قَالُوا أُسَامَةُ بْنُ زَيْدٍ ‏.‏ فَأَتَاهُ فَكَلَّمَهُ فَزَبَرَهُ وَقَالَ ‏ “‏ إِنَّ بَنِي إِسْرَائِيلَ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ الْوَضِيعُ قَطَعُوهُ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُهَا ‏”‏ ‏.‏
It was narrated that ‘Aishah said:
“A woman of Quraish, from banu Makhzum, stole, and she was brought to the Prophet. They said: ‘Who will speak to him concerning her?’ They said: ‘Usamah bin Zaid.’ So he came to the Prophet and spoke to him. But he rebuked him, and he said; ‘Among the Children of Israel, if a noble person stole, they would let him go. But if a low-class person stole, they would cut off his hand. By the One in whose hand is the soul of Muhammad, if Fatimah bint Muhammad were to steal, I would cut off her hand.””

عَنْ عَائِشَةَ، أَنَّ قُرَيْشًا، أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ صلى الله عليه وسلم قَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلاَّ أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ صلى الله عليه وسلم فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏”‏ أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ‏”‏ ‏.‏ ثُمَّ قَامَ فَاخْتَطَبَ فَقَالَ ‏”‏ يَا أَيُّهَا النَّاسُ إِنَّمَا هَلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا ‏”‏ ‏.‏ قَالَ مُحَمَّدُ بْنُ رُمْحٍ سَمِعْتُ اللَّيْثَ بْنَ سَعْدٍ يَقُولُ قَدْ أَعَاذَهَا اللَّهُ عَزَّ وَجَلَّ أَنْ تَسْرِقَ قَدْ أَعَاذَهَا اللَّهُ عَزَّ وَجَلَّ أَنْ تَسْرِقَ وَكُلُّ مُسْلِمٍ يَنْبَغِي لَهُ أَنْ يَقُولَ هَذَا ‏.‏
It was narrated from ‘Aishah :
that Quraish became concerned about the case of the Makhzumi woman who had stolen, and they said: “Who will speak to the Messenger of Allah (ﷺ) concerning her?” They said: “Who would dare to do that other than Usamah bin Zaid, the beloved of the Messenger of Allah (ﷺ)?” So Usamah spoke to him, and the Messenger of Allah (ﷺ) said, “Are you interceding concerning one of the legal punishments of Allah (SWT)?“ Then he stood up and addressed (the people) and said: “O people! Those who came before you were only destroyed because when one of their nobles stole, they let him off, but when one of the weak people among them stole, they would carry out the punishment on him. By Allah, if Fatimah the daughter of Muhammad were to steal, I would cut off her hand.” (Sahih)(One of the narrators) Muhammad bin Rumh said: “I heard Laith bin Sa’d say: ‘Allah(SWT) protected her (Fatimah) from stealing, and every Muslim should say this.’”
