What is the HCGRA?

A

The Housing Construction Grants Regeneration Act 1996, following the Latham report. It allows for interim payments to any works over 45 days, suspension of works for non-payment, adjudication and removal of pay when paid clauses.

What is the LDEDCA?

A

The Local Democracy, Economic Development and Construction Act 2009 was a update to the Construction Act and included payment terms (due date, final date for payment, pay less), slip rule in adjudication, oral contracts, removal of pay when certified clauses.

What is the Scheme for Construction Contracts?

A

This allows for parties who have entered into a contract which do not provide for the relevant provisions i.e. the contract fails to comply with the Construction Act 1996.
Part 1 = adjudication and Part 2 = payment terms

What is the Slip rule?

A

UK construction law requires construction contracts to include provision in writing permitting the adjudicator to correct his decision so as to remove a clerical or typographical error arising by accident or omission. Under the Scheme for Construction Contracts, the adjudicator must make any alteration to the decision within 5 days of the initial decision being made.
