Rehab Act of 1973
First major legislative effort to secure an equal playing field for individuals with disabilities. Prohibits discrimination on the basis of disability in programs run by federal agencies; programs that receive federal financial assistance; in federal employment
Section 504 of Rehab Act - 1973
Prevents discrimination based on disability.
Schools must provide equal access and opportunities by providing reasonable accommodations (This is NOT remediation)
No need to be eligible for special education to be eligible for Section 504
The Education for all Handicapped Children Act (EHA) -1975
All “handicapped” students have the right to a free and appropriate public education (FAPE) and this education must occur in the least restrictive environment (LRE). In 1986 (11 years later)- this was amended to be more all inclusive…………
EHA- 1986
Part H: incorporated Early Intervention Services (EIS) providing special services to qualifying children ages birth to 3 years old (age out on 3rd birthday). This includes OT, PT, ST, and special instruction. This is the state’s responsibility!
Part B: incorporated special education and related services to preschool children aged 3-5 years old who present with disabilities and/or qualifying delays. This is the school system’s responsibility!

ADA- 1990
Attempt to rectify past discrimination against those with physical and mental disabilities
Covers employment and public services
Covers parents of a child with a disability
IDEA -1990
Changed the language from the EHA legislation: “Handicapped Children” became “Children with Disabilities”
IDEA- 1991 Amendments
Added a section to include assistive technology
Added a section on the provision of transition services (with a transition plan to adult life)
IDEA- 1997 Amendments
Increased focus on LRE with respect to “regular ed” so have regular ed teacher on IEP team
These students will participate in state and district testing with accommodations
New disability categories for ADHD &
DD Requires services and funding for private schools Rules regarding disciplinary action for students with disabilities (FBAs and BIPs)
NCLB- 2001
Goal to increase k-12 academic achievement with emphasis on disadvantaged students Using “proven educational methods”- evidence-based practice
Strengthens “highly qualified teachers”
School systems to show greater accountability for results of academic assessment must demonstrate AYP (adequate yearly progress) if school does not meet AYP, parents have option to choose another school
IDEA- 2004 Reauthorization
Helped align IDEA 1997 with NCLB Emphasis on outcomes to make schools more accountable
Provision of supplemental services for under-performing schools
Helped streamline procedures
