What is legislation?
Refers to laws which are passes in a country. It protects citizens of a country and is passed through parliament.
It is illegal and punishable = fines/prison to break the law
What are the 5 legislation acts?
Equality act Mental health act Mental capacity act Care standards act Children act
What is the equality act (2010)?
Legally protects people from discrimination in the workplace and wider society.
What is the mental capacity act (2005)?
Protects those that can’t make their own decisions making sure that any decision made for them are in their best interests.
What is the care standards act (2000)?
Register care services that meet the standards.
They inspect services to check that they continue to do so and take action when they don’t.
What aspects of care does the care standards act (2005) cover?
Treating people with dignity and respect
Food and drink needs are met
Environment clean and safe.
How does the care standard act carry out inspections?
Ask people about experiences on receiving care
Talk to care staff
Check night systems and processes are in place
What do the care standards act do when the care standards aren’t being met?
Issue fines/warnings
Stop admissions into a care service
Suspend/cancel a care services registration
What does the children’s act (2004) do?
Provides the legal basis for how social services and other agencies deal with issues relating to children. These guidelines have been laid down so that individuals are aware of how children should be looked after in the eyes of the law.
What are the guiding principles states in the children’s act (2004)?
Allow children to be healthy
Helping children to enjoy life
Allow children to remain safe on their environment
What is the mental health act (2007)?
Allows people with a mental disorder to be admitted it hospital, detained and treated without their consent.
What are formal patients?
Patients that are not free to leave and have fewer rights than other patients.
