What does RIPA do?

What is a data subject?
Someone with data stored about them outside of their control
What is a data controller?
Someone who determines what data an organisation collects and how it it collected, processed and stored
What is a data commissioner?
A public body who has the power to enforce the data protection act, reports directly to the Crown and government
What is personal data?
General information about you (name, address, bank details….)
What is sensitive data?
Data that may allow discrimination (nationality, ethnicity, political beliefs….)
This is subject to additional legal protections
What are the 8 principles of DPA 1998?
- data collected and used faily and lawfully
- only held for specific reasons
- only used for the registered purpose
- adequate, relevant and not excessive
- kept accurate and up to date
- not kept longer than needed
- kept safe and secure
- not transferred outside EEA unless country has data protection
What rights do the subject have under DPA?
- Right of subject access

- right to prevent distress
