Q

Discuss the Zambian Legal Environment

A

Zambia has a dual legal system comprising the Indigenous Customary Law Systems of the various ethnic groups in the country and the Received English System.
Zambia decided at independence to use both customary law and statutory law. The latter is based on the English common law system and is dominantly applied in the higher courts of law (Subordinate Courts to the Supreme Court).
Zambia follows the doctrine of separation of powers.
The Constitution provides for the creation and existence of three main organs of the State that are fundamental pillars of the democratic governance of the country, namely the Executive, the Legislative and the Judiciary.
