What are paramedics mandatory reporters for?
spouse abuse, child abuse, neglect, elder abuse, sexual abuse, gunshot and stab wounds, animal bites, communicable diseases (HIV is an example)
Negligence
Deviation from accepted standards of care.
4 things must be proved:
- failure to act
- breach of duty
- actual damges
- proximate cause (courts deem the event to be the cause of that injury) Cause was directly proportional to your actions
Breach of Duty
an action or inaction that violates the standard of care expected from a paramedic.
malfeasance
performance of a wrongful or unlawful act
purposeful and wrong doing
misfeasance
performance of a legal act in a harmful or injurious manner
nonfeasance
failure to preform a required act or duty.
