Title Act
It does not prevent anyone from working that trade or profession; however, it does prohibit anyone using the regulated title until they are licensed.
Cannot use the term landscape contractor without a license from the occupational licensing board
NC Sedimentation Pollution Control Act 1973
Prohibits offsite sedimentation; install /maintain erosion control to sediment within site’s boundaries
Regulated through DENR (Department of Environment & Natural Resources)
Erosion/Sediment Control Plan
- Must submitted 30 days before land is disturbed (1 acre or more)
- 25’ buffer along waterways; contain visible sediment to the first 25% of buffer
- slope angle cannot be greater than what can be stabilized by vegetation
- stabilize graded slopes within 30 days with veg
- control must be able to withstand 10yr - 25yr rain storm
- Sedimentation Control Commission within DEHNR
Practice Act
Governs all of the actions of individuals in that profession or trade. No one can practice that trade/profession without a license.

- given out by NCDA & CS ( NC Dep. of Agriculture & Consumer Services)
- if you apply a product that controls a pest on another persons property & you are compensated you must have a license.
