Surety Bond

A
  • Included in general conditions & inst. to bidders
  • guarantees contractor will execute the contract & pay all the bills
  • 4 Types: bid bond, performance bond, payment bond, labor & materials payment bond

Bid Bond

A

Guarantees contractor will agree to contract if accepted; if contractor does not & withdraws bid, surety co. Forfeits bond (5-10% of bid)

Performance Bond

A

Protects owner from poor/defective work usually the amount of full contract. If contractor does not complete work, surety co will either act as general contractor to finish job; locate another contractor to complete the job; or pay owner remaining amount (less the prorated amount for work completed)
