Guideline 1
(Not compulsory)
Can ask questions of any person, but must NOT suggest it is compulsory for the person questioned to answer.
Guideline 2
(Rights Caution)
If sufficient evidence to charge, then must caution BEFORE inviting to make a statement or answer questions.
Guideline 3
(Cross-examination)
If in custody and/or have sufficient evidence to charge, then questioning must NOT amount to cross-examination.
Guideline 4
(Explain evidence)
If questioning about witness statements and CCTV etc, then substance of statements and evidence must be fairly explained.
Guideline 5
(Review record)
DVD interview unless impractical or suspect declines, then audio or NBX.
Give opportunity to review the record, correct any errors, or make any additions.
Give opportunity to sign NBX as an accurate record of the conversation.
