IA policy three things:
- must implement an IA policy
- monitor and track the behavior of their officers
- when found to engage in misconduct, must correct behavior
- prevention is the primary means of reducing and controlling inappropriate behavior and misconduct
- internal affairs form
- retrieve all digital and audio recordings
- take photos of complainant and officer if it involves excessive force
AG policy requirements
written policy
must accept reports from all sources, including anonymous
criminal conduct, must notify prosecutor immediately
any use of force notify prosecutors
thoroughly and objectively investigate all allegations
must notify all officers of complaints and their outcomes
establish and maintain IA record system
Early warning system
quarterly reports to the prosecutor
annually release to the public
* notify in writing complainant and/or officer of outcome
Immediate suspension
unfit for duty
hazard to any person
maintain safety of public
charged with 1, 2 or 3 degree crimes
or charged with any crime while on duty unless PDP
* such as an officer reporting to work under the influence/ suspended and provided with a written statement of actions taken/ executive notified immediately
Filing of charges
must be filed within 45 days of the date the person filing the charge obtained sufficient info
- criminal investigation suspends the 46 day rule
- misconduct + unfit = no 45 day rule
*disciplinary report should be removed 6 months after reprimand or notice
Retention Schedule
criminal homicide permanently maintained
criminal matter resulting in arrest of officer 75 yrs
all others career of officer plus 5 years
IA info released only if:
all discoverable material shall be provided to the officer and hearing officer
IA invest reports may be released to the attorney representing the officer
request of prosecutor or attorney general
upon a court order
reporting
should be prepared at least quarterly
- where suspension of 10 days or more were assessed*
- criminal interviews should only be conducted with prior approval by the prosecutor
early warning system
IA’s responsibility
detect patterns and trends before the conduct escalates
