Officer shall wear BWC when:
has been authorized to do so by the chief officer
has received training on the proper care and use
- if malfunction occurs must tell the supervisor before going on the field*
- every agency should inform its citizenry either through its website or municipal website
Shall be required to activate the device if any of the following:
investigative detention
call for service
motorist aid or community caretaking check
interview witness in invest of criminality
custodial interrogation unless at the station house
making an arrest
protective frisk for weapons
any kind of search
response to any type of civil disorder which may be required to employ constructive authority or force
transporting an arrestee
any officer on scene has done anything of the above
Shutting off the device
an officer may deactivate device if civilian request that it be turned off if it appears that the person will not provide info or otherwise cooperate with the officer
must state why he is shutting it off before doing so
shall not activate the BWC when entering:
school
health care facility
place of worship
Retention of BWC recordings
shall not be less than 90 days
agency receiving subpoena or OPRA shall within 1 business day and before complying with it provide notice to the prosecutors or division of criminal justice
