What is the formal procedure for carry out of visual identification found in S45 Evidence Act 2006
Procedure for obtaining visual identification evidence..
Needs to be observed as soon as practicable after the alleged offence is reported
The person to be identified is compared to no fewer than 7 other persons who are similar in appearance to the suspect
N indication is given to the person making the identification as to who the suspect is
The person making the identification is informed that the suspect may or may not be among the persons in the procedure

SPECIAL RULES about searching PERSONS
If a person exercises a power to search a person, the person exercising the power must-

May detain a person to enable search to be carried out (for as long as necessary to achieve purpose)
May use force that is reasonable for the purposes of the search
May seize any thing carried by that person or in their immediate control
May copy any document seized in search
May use reasonable measures to access computer system or data storage device if any material subject to the search may be in that computer system or other device.
Also includes:
Assistance of medical practitioner, parent/gaurdian.
For strip search, may request assistance from another law enforcement officer who is:
Authorised under any enactment to conduct strip search
Same sex of person being searched

INVENTORY of ITEMS being SEIZED
The person who carries out the search must at the time of seizure or as soon as practicable, and no later than 7 days, provide the person in which the seizure took place with:
Written notice specifying what was seized

REPORTING of exercise of POWERS within law enforcement agency
Any Constable who exercises a warrantless entry power, search power, or surveillance power must provide a written report on the exercise of that power as soon as practicable.
Report must contain:
A short summary of the circumstances surrounding the exercise of the power.
Reasons why the power needed to be exercised
State whether any evidential material was siezed or obtained
State whether there are any criminal proceedings as a result
Report not needed for:
A search undertaken on a person after arrest
Exercise of a power of entry that does not confer a power of search
Search by consent

by being left for the person at the person’s place of residence with a member of the person’s family living with him or her who appears to be of or over the age of 18 years.
