Warrantless search of PLACES and VEHICLES in relation to some Misuse of Drugs Act offences
A Constable may enter and search a place or vehicle without warrant if they have reasonable grounds to believe that:
It is not practicable to obtain a warrant, and that in that place or vehicle there is a controlled drug.
To believe that if entry and search is not carried out immediately, evidential material relating to the suspected offence will be destroyed, concealed, altered or damaged.

For a duration that is reasonable to cary out the search:
Secure the place or vehicle or any area or thing found in that place or vehicle

Exclude any person from the place or vehicle being searched if there is reasonable grounds to believe that that person will obstruct or hinder the exercise of any power under this section

Powers of DETENTION incidental to powers to SEARCH PLACES and VEHICLES
For the purposes of determining if there is a connection between a person at that place or vehicle, detain any person who;
Is at the place or vehicle at the commencement of the search or if they arrive at the place or stop at, enters, or tries to enter the vehicle while the search is being carried out.
Detain for a reasonable time, no longer than the duration of the search
Reasonable force may be used to continue any detention

Identification and notice requirements for person exercising search power
Before initial entry:

Provide occupier of place or person in charge of vehicle with;
A copy of search warrant OR The name of the enactment
Comply with above unless;
no person is lawfully present in the place or vehicle, there is a danger to the safety of any person.
Reasonable force may be used to effect entry if
the person refuses or does not allow entry in a reasonable time.

Miscellaneous Offences
Every person commits an offence who:
Has in their possession any pipe or other utensil for the purpose of the commission of an offence against this act.
Has in their possession a needle or syringe that they could not have reasonably believed was obtained from a pharmacy or approved medical practitioner.
Initial response protocols when discovering a suspected clan lab
Immediately remove people from the area if safely able to do so.
Cordon and contain, consider specialist squads if suspect has barricaded themselves.
Those who entered the clan lab segregate themselves with those who haven’t
Advise Comms supervisor and NCO
Consider ambo and fire, appoint incident controller
keep power and water supplies on
Don’t attempt to stop chemical reaction or touch, taste or smell any chemicals or equipment
Dont operate radios or cell phones inside the clan lab
Process of storing drug exhibits
Whether they are obtained by a search or handed in by a member of the public, a Drug Search and Seizure notification must be completed
The drugs must be recorded in a drug exhibit form and stored with a copy of the DSS
