Human Rights Act 1998
first codified list of rights in the UK, passed in 2000 by Blair
important articles
article 2 - right to life
article 3 - freedom from torture
article 10 - freedom of expression
article 14 - protection from discrimination
3 main effects of HRA
- can seek justice in a British court
- public bodies must respect your rights
- new laws are compatible with European convention rights
problem with the HRA
- P. SOV means gov can revoke the HRA, and there is nothing to stop a gov from infringing upon peoples human rights
Abu Qatada case
Argued as HRA giving undeserved protection
- Abu was a violent extremist
- he was prevented from being deported to Jordan by article 3 - freedom from torture as torture is legal in Jordan
Rwanda 2022 HRA issues
The UK supreme court ruled that the plan to send asylum seekers to Rwanda broke article 2 (right to life), 3 (freedom from torture) ,5 (right to security) as Rwanda have no HRA. They also found that seekers sent there could be forced back to the country they had originally fled from.
