constitution twin pillars Flashcards
what are Dicey’s twin pillars
the principles of the UK constitution (P.sov and rule of law) are the twin pillars.
rule of law pillar - everybody, including gov, must obey
P.sov pillar - the body with the highest authority to makes the laws
why do elective dictatorships cause the pillars to crumble
governments with large majorities (Blair in 1997 with 418 seats) can dominate Parliament meaning it is harder to hold the Government to account
why do demise of law/cost of court cause the pillars to crumble
it has become too expensive to apply the rule of law equally due to the rising cost of legal action
why does doubt of Parliamentary sovereignty cause the pillars to crumble
joining the EU (before leaving it) and devolution challenge the idea of Parliament being fully sovereign
why does the participation crisis cause the pillars to crumble
low voter turnout shows political disengagement and challenges the efficiency of having a representative democracy
why does less respect for gov cause the pillars to crumble
scandals, controversy (Partygate) and corruption reduce public trust in gov
